• <br /> 1 Yost is the owner of real property located at 3135 Tulalip Avenue,Everett, Snohomish <br /> 2 County,Washington(the"Property"). Code violations have plagued the property for at least the <br /> 3 past ten years. Yost's Property is a blight on the neighborhood, a former drug den, and an <br /> 4 attractive nuisance to trespassers. <br /> 5 A. Past code violations. <br /> 6 Since 2006 Yost's Property has been a regular complaint to the City's code enforcement <br /> 7 <br /> department. Yost has a history of code violations at the Property that include: <br /> 8 <br /> • 2006—Multiple inoperable vehicles; discarded salvage materials, appliances, and <br /> 9 vehicle parts littering the exterior Property.1 <br /> 10 . 2007—Inoperable vehicle;junk,trash,vehicle parts,discarded furniture, and other <br /> 11 personal items littering the exterior of the Property.2 <br /> 12 • 2008—Inoperable vehicle;trash, lumber debris,vehicle parts,discarded and <br /> damagedplastic roof,and other personal items littering the exterior of the <br /> 13 Property. <br /> 14 . 2011 —Inoperable vehicle;junk,trash, salvage materials,discarded furniture and <br /> 15 other personal items littering the exterior of the Property. <br /> 4 <br /> 16 B. Current code violations <br /> 17 More recently, On December 12,2013,the City condemned the house as unfit for human <br /> 18 habitation pursuant to IPMC 108.1.1. and 108.1.3,because it was being occupied without utilities.5 <br /> 19 <br /> (To date,the condemnation has not been lifted, and the house remains without utilities.6) Then,on <br /> 20 <br /> December 31,2013,the City served Yost with a violation citation for various code violations on <br /> 21 <br /> 22 the Property. These conditions are also the basis for the City's Complaint in this action.
