i <br /> 1 December 31 violation citation described several conditions on the Property that were violations of <br /> 2 City Code. These conditions included: <br /> 3 • An accumulation of junk,fim-dture,tires,household equipment,vehicle parts, and <br /> articles of personal property on the exterior of the property and visible to the neighbors <br /> 4 and public in violation of chapter 8.20 EMC;' <br /> 5 • Overgrown vegetation including tall weeds, grass over 12 inches in height, and shrubs <br /> 6 growing over the sidewalk and obstructing pedestrian traffic also in violation of chapter <br /> 8.20 EMC and EMC 8.08.020;8 <br /> 7 <br /> • A failure to maintain the house including,broken windows, damaged and missing <br /> 8 gutters,missing guard rails and a deteriorated roof in violation of various provisions of <br /> the International Property Maintenance Code as adopted by the City(the"IPMC") (see <br /> 9 IPMC 301.3, 108.1.1,and 108.1.3;9 and <br /> 10 <br /> • A failure to obtain permits and/or permit inspections for alterations to the house in <br /> 11 violation of the International Residential Code(as adopted by the City) (the"IRC") <br /> sections R105.1 and RI 13.1. <br /> 12 <br /> 13 The violation citation again explained the basis for the December 12 condemnation and it <br /> 14 instructed Yost to abate all violations on the Property. <br /> 15 In the violation citation,the City described corrective action that Yost could take to <br /> 16 avoid going to a hearing on the matter, including removing the junk from the yards,trimming or <br /> 17 cutting back and properly disposing of the overgrown vegetation, and obtaining permits, <br /> 18 inspections, and ultimately, approval to occupy the house from the building department. <br /> 19 <br /> Yost did not complete the corrective action and a hearing was held on January 23, 2014. <br /> 20 <br /> Yost attended the hearing and provided testimony.
