f <br /> FINDINGS OF FACT <br /> l <br /> 2 1. Defendant Lynda Yost("Yost")is the owner of real property located at 3135 <br /> I <br /> 3 Tulalip Avenue,Everett,Snohomish County,Washington(the"Property"). 4 <br /> 4 2. The Property has been the subject of City investigations into claims of public <br /> 5 nuisance conditions going back to 2006. <br /> 6 3. It was also the site of a drag nuisance abatement action in 2011. The drug nuisance <br /> 7 <br /> abatement action resulted in the Court issuing an injunction vacating and closing the property. <br /> 8 <br /> Pursuant to the injunction the Property was vacated on December 20,2011,and remained vacated <br /> 9 <br /> 10 and closed for ahnost two years. The Court,at the parties' request,dissolved the injunction on <br /> I I November 13,2013. <br /> 12 4. Over the years discarded junk,fumiture,tires,household equipment,vehicle parts, <br /> 13 and other articles of personal property have accumulated in the yards on:the Property. � <br /> 14 5. Vegetation has become overgrown and an obstruction to pedestrian traffic on the <br /> 15 <br /> sidewalk abutting the Property. <br /> 16 <br /> 6. The house on the Property is in deteriorating and heavily fire damaged. It has <br /> 17 <br /> broken windows, damaged and missing gutters,missing guardrails. <br /> 18 <br /> 19 7. Further,the house has been substantially altered without permits and/or without <br /> 20 necessary permit inspections. <br /> i <br /> 21 8. On December 31,2013,the City served Yost with a violation citation for various <br /> 22 code violations on the Property. <br /> 23 9. The December 31 violation citation described conditions in the yards and of the <br /> 24 <br /> house.
