The violation citation listed the provisions of the Everett Municipal Code(the <br /> i <br /> 4 "EMC"),the International Property Maintenance Code as adopted by the City of Everett(the <br /> 5 "IPMC"), and the International Residential Code as adopted by the City of Everett(the"IRC") <br /> 6 violated by the conditions in the yards and of the house. <br /> 7 <br /> 11. The violation citation instructed Yost to abate all of the code violations on the <br /> 8 <br /> Property. <br /> 9 <br /> 10 12. A scheduled hearing before the City's Violation Hearings Examiner(the <br /> 11 "Examiner") occurred on January 23,2014. <br /> F <br /> a <br /> 12 13. Yost attended the hearing and provided testimony. <br /> 13 14. Following the hearing on January 23,the Examiner issued Findings of Fact, g <br /> 14 Conclusions of Law, and Order(the"Decision")finding Yost in violation of provisions of the <br /> 15 <br /> EMC,IPMC, and IRC. <br /> 16 <br /> 15. The Decision stated: s <br /> 17 <br /> 1. By allowing discarded litter,junk,furniture,tires,household <br /> 18 equipment,vehicle parts and articles of personal property.to <br /> 19 accumulate and remain in the yards of the property in public view,the <br /> Respondent violated EMC 8.20.020(A)(C)(G). These violations are <br /> 20 public nuisances. <br /> r <br /> 21 2. By allowing vegetation on the property to exceed twelve (12)inches in <br /> height and shrubs to grow over the sidewalk thereby obstructing <br /> 22 pedestrian traffic,the Respondent violated EMC 8.20.020(E). These <br /> 23 violations are public nuisances. <br /> 3.
