By allowing construction work to occur on the structure without <br /> required City inspections and approvals,the Respondent violated IRC <br /> 2 2009 R105.1 and IRC 2009 R113.1. <br /> 3 S. By failing to maintain the vacant structure and yards on the property, <br /> the Respondent violated IPMC 301.3. <br /> 4 <br /> 5 6. The Examiner held that the conditions on the Property in violation of EMC <br /> 6 8.20.020 were public nuisances. <br /> 7 7. The other conditions that violated the IPMC and IRC are also nuisances pursuant to <br /> 8 EMC 16.005.040.A.12. <br /> 9 S. Yost did not appeal the Examiner's Decision. Q <br /> 10 9. To date,Yost has taken little if any steps to bring the house on the Property into <br /> 11 <br /> compliance with City codes. For example,since the Examiner's Decision,she has not applied for <br /> 12 <br /> any building permits necessary to begin lawful alterations or repairs to the house. <br /> 13 <br /> 14 10. After the Examiner issued his Decision a fire significantly damaged the second <br /> 15 <br /> story of the house in April 2015. Over a year has passed,but Yost has not applied for building <br /> 1 <br /> 16 permits to repair the fire damage. <br /> 17 11. Currently,parts of gutters are hanging loose,the back porch is rotting,a railing <br /> Y <br /> { <br /> 18 from the upper deck is hanging from a post,and the file damage remains. A tate covering the fire j <br /> i <br /> 19 damaged roof has blown loose making the interior of the house susceptible to weather. <br /> 20 <br /> 12. Yost has not preserved the house from further deterioration. <br /> 21 <br /> 13. The house has not been lawfully occupied since it was closed pursuant to the drug <br /> 22 <br /> 23 <br /> nuisance abatement in 2011. <br /> 24 14.
