1 April 2015. <br /> p <br /> 2 2.6.4 The City continues to receive complaints from neighbors about the state of <br /> 3 the Property and unlawful activity associated with the Property. <br /> 4 2.6.5 Yost has made substantial alterations to the house without required building <br /> 5 permits and/or permit inspections. <br /> 6 <br /> 2.6.6 The house has deteriorated and has been significantly damaged by fire. <br /> 7 <br /> Yost had not taken any action to preserve the sft ucture. <br /> 8 <br /> ORDER <br /> 9 <br /> 10 <br /> 1. Summary Judgment in Favor of the City is Granted <br /> 11 THE COURT,having reviewed the City's Motion for Summary Judgment Declaring <br /> 12 Public Nuisances and Issuing Injunction and Warrant of Abatement against Defendant Lynda J. <br /> t <br /> 13 Yost, and being familiar with the pleadings and submissions on file does hereby: <br /> 14 ORDER that the City's Motion is GRANTED. <br /> 15 <br /> 2. The Following Relief is Granted: <br /> 16 s <br /> 2.1 Injunctive Relief <br /> 17 <br /> 2.1.1. The Defendants shall not cause,allow,or maintain the nuisance conditions <br /> a <br /> 18 a <br /> described above on the Property in the future. <br /> 19 { <br /> 2.2 Warrant of Abatement <br /> 20 <br /> 2.2.1 The City of Everett,including its employees, officers, agents, or <br /> 21 <br /> 22 <br /> contractors,is hereby authorized to enter the Property to abate all nuisance violations set forth in <br /> 23 this Order any time between 8 a.m. and 5 p.m.Monday through Friday during the six months <br /> i <br /> 24 following the date of this Order. The City shall give Yost 48 hours notice of the abatement to <br /> 25 allow her to remove any personal property from the Property.
