1 5 <br /> All property and evidence recovered in connection with the investigation shall be <br /> maintained by a representative of the primary jurisdiction agency pursuant to their <br /> agency policies related to handling property and evidence. 1CART members may <br /> recover and process property and evidence for the primary jurisdiction agency. <br /> Prosecutorial and legal advisement <br /> Investigations involving endangered missing and abducted children may have instances <br /> that present law enforcement personnel with legal questions. The ICART team shall <br /> include an (CART Legal Advisorassigned by the Snohomish County Prosecutor's <br /> Office. <br /> The ultimate decision related to the proper and legal course of action lies with the <br /> prosecutorial office having jurisdiction in which the offense occurs. The ICART Legal <br /> Advisor, in consultation with that prosecutorial office, can act as a resource to both the <br /> jurisdiction's prosecutors and the ICART team. The ICART Legal Advisor may provide <br /> on-scene assistance with legal issues such as: <br /> • <br /> 1. Exigent circumstances <br /> 2..Search and seizure <br /> 3. Miranda <br /> 4. Canvass operations <br /> 5. Search warrant affidavits <br /> 6. Subpoena requests <br /> 7. Consultation with local prosecuting authority <br /> Because of the potential for rapidly evolving situations and the critical importance and <br /> implications, the ICART Legal Advisor will be immediately available to consult and <br /> assist on these matters. <br /> • <br /> SECTION 9: EQUIPMENT INVENTORY <br /> The (CART Incident Support Group shall maintain an up to date Equipment List and a <br /> Resource List to ensure the team has capacity to respond to a missing or abducted <br /> child with an appropriate amount of physical and asset resources. <br /> SECTION 10: VICTIM ASSISTANCE AND REEUNIFICATION <br /> Victim/Family Advocate/Liaison <br /> Reports of endangered missing or abducted children are very emotional and traumatic <br /> incidents, both for the family and responders attempting to safely recover and return the <br /> 19 <br /> • <br /> 73 . <br />
