ORDINANCE <br /> AN ORDINANCE granting permission to.Lynch Industrial Park, LLC for an overhead <br /> covered walkway across Wetmore Avenue, between Blocks 666 and 667,Plat of Everett, <br /> Snohomish County, Washington, approximately sixteen(16) feet south of California Street; and <br /> specifying the conditions under which this permission is granted. <br /> WHEREAS, <br /> A. In 1966,the Everett City Council by Ordinance No. 4146 granted to Alstore's <br /> Realty Company the right to construct,maintain, and operate an overhead covered walkway <br /> (the "Covered Walkway") across Wetmore Avenue between Blocks 666 and 667,Plat of <br /> Everett, Snohomish County, Washington, approximately sixteen(16) feet south of California <br /> Street. <br /> B. The rights granted under Ordinance No. 4146 were for 50 years and have expired. <br /> Ordinance No. 4146 provides that the permissions thereunder may be renewed. <br /> C. The current owner,Lynch Industrial Park,LLC ("Grantee" or"Lynch") desires <br /> to the renew the permissions to operate and maintain the Covered Walkway. <br /> D. The City agrees to renew such permissions and to again grant the right to operate <br /> and maintain the Covered Walkway, all as under set forth in this Ordinance. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Permissions—Administration— <br /> A. Covered Walkway. Subject to the terms and conditions of this Ordinance, <br /> the City hereby grants permission to Lynch maintain and operate an enclosed Covered Walkway <br /> over and across Wetmore Avenue between Blocks 666 and 667,Plat of Everett, Snohomish <br /> County, Washington, approximately sixteen(16)feet south of California Street, for the purpose <br /> of facilitating pedestrian travel. <br /> 21 <br />
