Both the Port Gardner Building and <br /> the parking garage are owned by Lynch Industrial Park,LLC(Lynch). Lynch recently purchased the two properties <br /> and requested a renewal of the permission granted in order to continue operating and maintaining the covered walkway <br /> that connects the two buildings. <br /> Lynch performed a structural engineering review of the condition and integrity of the existing covered walkway. City <br /> staff reviewed the findings for adequacy. <br /> The attached Ordinance provides for the continuation of the covered walkway across Wetmore Avenue subject to, <br /> among other things: 1)preservation of the City's rights to use the Wetmore Avenue right-of-way for public travel, <br /> utilities and other public purposes;2)a renewal term of twenty five(25)years; and 3)a one-time fee of$21,600 to the <br /> City for use of the Wetmore Avenue right-of-way. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Approve An Ordinance granting permission to Lynch Industrial Park,LLC for an overhead covered walkway across <br /> Wetmore Avenue, between Blocks 666 and 667,Plat of Everett,Snohomish County,Washington, approximately <br /> sixteen(16)feet south of California Street; and specifying the conditions under which this permission is granted. <br /> 1 <br />
