Exhibit 7 Go-Sync map of parcel <br /> Exhibit 8 Exhibit list dated December 2, 2010 <br /> ?A% T <br /> Based upon a review of the above record, the following Findings of Fact and <br /> Conclusions hereby constitute the basis of the decision of the Everett Violations Hearing <br /> Examiner. <br /> FINDINGS OF FACT <br /> 1. Respondent Lynn Claughton is the owner of record of the property located at 1502 <br /> Pine Street, Everett, Wash ington.(Testimony, Code Officer Fagerstrom, Exhibit #) ) <br /> 2. On May 13, 2010, a referral is made from the Building Services Department to the <br /> Code Enforcement Unit, requesting that an investigation be opened for 1502 Pine <br /> Street. It is reported that there is an illegal accessory dwelling unit, being occupied <br /> within a converted garage, upon the property.(Testimony, Ted Budden, Exhibit#X) <br /> 3. On May 14, 2010, Code Officer Kevin Fagerstrom conducts his first inspection at the <br /> property. He sees and photographs that there does appear to be an accessory <br /> dwelling unit as described. It is located in the detached garage, to the west of the <br /> main residence. It is marked on the outside of the building as 1502-A. Code Officer <br /> Fagerstrom speaks to the tenant, who confirms that he resides in this structure and <br /> that it is converted into a full living unit, complete with kitchen and bathroom. There <br /> also appears to be other constructed additions elsewhere on the property,that <br /> possibly do not meet proper construction standards, or site set-backs. The findings <br /> are reported back to the Building Services Department and to the Planning <br /> Department. (Testimony, Code Officer Fagerstrom, Exhibits #X&X) <br /> 4. On May 24, 2010, a Violation Citation was issued to the Respondent for a violation <br /> of International Residential Code 105.1; Everett Municipal Code 19.7.020.13 and <br /> 19.39.020.D(2) . A copy was mailed to the Respondent via first class and registered <br /> US mail and a copy was posted at the Property. At the time of the posting, Code <br /> Officer Fagerstrom speaks to the Respondent, who is present at the Property. The <br /> Respondent invites Code Officer Fagerstrom into the accessory dwelling unit to view <br /> an electrical permit that is posted on the power panel inside. Code Officer <br /> Fagerstrom is able to see that this is a complete dwelling unit. He further sees that <br /> there are several other instances, of what are clearly illegal electrical installations. <br /> (Testimony, Code Officer Fagerstrom, Exhibit #X) <br /> 5. On June 16, 2010, a meeting is held at the Building Services Department. The <br /> Respondent has contacted all three departments and has requested an extension to <br /> analyze his options. It is agreed by all city departments, that an extension can be <br /> granted, so long as the tenant is vacated from the illegal unit.
