6. On June 17, 2010, the Revised Hearing Date Notice is issued to the Respondent. <br /> The requirement to vacate the tenant, is included in the document. (Testimony, <br /> Code Officer Fagerstrom, Exhibit#X) <br /> 7. On July 7, 2010, a meeting is held at the Planning Department offices. The <br /> Respondent requested the meeting. Present are the Respondent, Code Officer <br /> Fagerstrom, Kirk Brooks and Tony Lee from the Building Department and Gerry <br /> Ervine and Teresa Firnstahl from the Planning Department. The Respondent is <br /> requesting that he not be required to make all of the changes which have been <br /> communicated to him during his recent meetings with city staff. A new hearing date <br /> is agreed to by Code Officer Fagerstrom, contingent upon the illegal unit being <br /> vacated. (Testimony, Code Officer Fagerstrom) <br /> 8. On August 3, 2010, the Respondent e-mails Code Officer Fagerstrom, confirming <br /> that the tenant has moved out. (Testimony, Code Officer Fagerstrom) <br /> 9. On November 15, 2010, Combination Permit #WC1010-002 is issued to the <br /> Respondent to conduct construction activity to bring the Property into full compliance <br /> with the Everett Municipal Code. (Testimony, Tony Lee) <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> The Violations Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision. That authority is set forth in EMC §1.20.020. <br /> Jurisdictional authority of this matter shall continue for two years from the date of entry <br /> of this order, or until specifically terminated by further order of the Violations Hearings <br /> Examiner EMC 1.20.040 F.10. <br /> Applicable Law: <br /> 1.
