Respondent Lynn Claughton is the owner of record of the property at 1502 Pine <br /> Street, Everett, Washington ("property"). (Exhibit#9, Snohomish County Assessor <br /> Record; Testimony of Mr. Fagerstrom). The property is zoned R-2 by the City of <br /> Everett. In an R-2 zone detached accessory detached dwelling units are not a <br /> permitted use. (Exhibit 7; Testimony of Mr. Ervine) <br /> 2. On May 13, 2010, a referral was made from the City of Everett Building Services <br /> Department ("Building") to the City of Everett Code Enforcement Unit, requesting <br /> that an investigation be opened for the property. In the referral a Building Inspector, <br /> Ted Budden, stated that a garage on the Property had been converted to an illegal <br /> accessory dwelling unit. He submitted that the converted building had "numerous <br /> Code/Safety concerns that should be addressed ie: electrical system, plumbing <br /> system, Building/;Housing requirements, Energy Code requirements etc". (Exhibit# <br /> 6; Email from Ted Budden; Testimony of Mr. Budden) <br /> 3. On May 14, 2010, Code Enforcement Officer Kevin Fagerstrom conducted his first <br /> inspection at the property. He observed and photographed the accessory dwelling <br /> unit that had been identified by Inspector Budden. The dwelling unit had been <br /> developed in the detached garage west of the main residence on the property. The <br /> address numbers on the outside of the building were 1502-A. (Testimony of Mr. <br /> Fagerstrom) <br /> 'Notice is taken that the City of Everett City Council recently withdrew any review of an ordinance that would have <br /> allowed detached accessory detached dwellin;units if it had passed. The prohibition remains within R-2 zoned <br /> properties. <br /> 2 / <br />
