Code Officer Fagerstrom spoke to a tenant unit 1502-A, who confirmed that he lived <br /> in the structure, and, that it had converted into a full living unit with kitchen and <br /> bathroom facilities. At that same time Code Officer Fagerstrom observed what <br /> appeared to be other construction additions on the property that possibly did not <br /> meet proper construction standards or required site set-backs. The findings were <br /> reported to Building and to the City of Everett Planning Department. (Exhibit# 1a-1b, <br /> Inspection photos dated May 14, 2010; Testimony of Mr. Fagerstrom) <br /> 5. On May 24, 2010, a violation citation was issued to the Respondent for a violation of <br /> International Residential Code 105.1; Everett Municipal Code 19.7.020.13 and <br /> 19.39.020.D (2). A copy was mailed to the Respondent via first class and registered <br /> US mail and a copy was posted at the Property. At the time of the posting, Code <br /> Officer Fagerstrom spoke to the Respondent, who was at the property. The <br /> Respondent invited Code Officer Fagerstrom into the accessory dwelling unit to view <br /> an electrical permit that was posted on the power panel. During this visit Code <br /> Officer Fagerstrom was able to see that the garage structure was a complete <br /> dwelling unit with all plumbing and electrical features of a living unit. He further <br /> observed what appeared to be other illegal electrical installations within the structure <br /> that were not covered by the posted electrical permit. On June 16, 2010, a meeting was held <br /> at the City of Everett's Building Services Department with the presence of the <br /> Respondent and the Departments of Building, Code Enforcement and Planning <br /> staffs. It was agreed by the City departments that an extension could be granted if <br /> the tenant on site vacated the illegal unit. (Testimony of Mr. Fagerstrom and Mr. <br /> Ervine) <br /> 7. On June 17, 2010, a revised hearing date notice was issued to the Respondent. A <br /> requirement to vacate the accessory dwelling structure1502 A Pine Street was part <br /> of the notice document. On July 7, 2010, pursuant to a request by the Respondent, another meeting was <br /> held at the City of Everett Planning Department offices. Present at that meeting <br /> were the Respondent, Code Officer Fagerstrom, Kirk Brooks and Tony Lee of the <br /> Building Department and Gerry Ervine and Teresa Firnstahl of the Planning <br /> Department. The Respondent requested that he not be required to make all of the <br /> changes that he had be instructed to do at previous meetings. He was informed by <br /> staff that if the changes were not made the matter would go to hearing. A new <br /> hearing date was agreed to contingent on the illegal unit being vacated.
