Everett Municipal Code 19.39.020.1)(2) which reads; <br /> Each single family dwelling on a legal building lot shall not have more than one <br /> accessory dwelling unit. No accessory dwelling unit may be located in any <br /> detached accessory structure. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By converting the garage into a dwelling unit and by conducting construction activity <br /> including the construction of interior walls and the installation of electrical wiring and <br /> plumbing fixtures without permits, the Respondent has violated International <br /> Residential Code 105.1 and Everett Municipal Code 19.7.020(B) and Everett <br /> Municipal Code 19.39.020.1)(2). <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 1. The Respondent shall not allow any tenants to reside in the accessory structure <br /> identified in these proceedings as 1502 A Pine Street. No tenants are allowed in <br /> order that there is strict compliance with all of the provisions of RCW 59.18, the <br /> Washington State Landlord-Tenant Act, <br /> 2. The Respondent shall bring the Property into compliance with the Everett Municipal <br /> Code, by completing the following tasks; <br /> A. Move the south wall of the garage (the building directly adjacent to the alley) to a <br /> minimum of 5 feet from the south property line, and move the north part of the <br /> structure so it is no further north than the north wall of the adjacent accessory <br /> building. <br /> B. Modify the deck structure extending into the north setback area so that it does not <br /> extend beyond the north wall of the accessory building or so it does not extend <br /> more than 3 feet above grade within the required setback area. <br /> C. Remove the roof of the patio cover or any combination of other roof structures to <br /> the extent that lot coverage by all structures with a roof covering does not exceed <br /> 40 percent of the total lot area. <br /> D.
