CITY OF EVERETT PUBLIC WORKS 00 21 13 <br /> SPECIAL PROVISIONS INSTRUCTIONS TO BIDDERS <br /> 1.27 DBE/WBE SUBCONTRACTOR REQUIREMENTS <br /> A. The Contractor is required to actively solicit bids for subcontract work from "Disadvantaged <br /> Business Enterprises"(DBE's)and"Women's Business Enterprises"(WBE's). <br /> B. The Contractor is required also to document such effort on the "City of Everett <br /> Disadvantaged/Women's Business Enterprise" form and to submit said form, in accordance <br /> with Document 00 45 39 of the Contract Documents,with its Bid. <br /> 1.28 NON-COLLUSION AFFIDAVIT <br /> A. The Contractor must submit a "Non-Collusion Affidavit" in accordance with Document 00 45 <br /> 19 of the Contract Documents as part of the Bid package. <br /> B. If the City has reason to believe that collusion exists among Bidders, the City will reject the <br /> Bids of the known participants in such collusion and may, at its option, require that all Bidders <br /> certify under penalty of perjury,that no collusion has occurred or exists. <br /> 111 <br /> 1.29 STATE SALES TAX <br /> A. The Washington State Department of Revenue has issued special rules on the State sales tax. , <br /> B. The Contractor should contact the Washington State Department of Revenue for answers to <br /> questions in this area. <br /> C. The City will not adjust its payment if the Contractor bases a Bid on a misunderstood tax <br /> liability. <br /> D. The Contractor shall not include State retail sales taxes in the unit bid prices. <br /> 1. A separate line item for applying State retail sales tax is provided in the Bid Form. I <br /> 1.30 LIMITATIONS REGARDING CONTRACTOR'S CLAIMS FOR DAMAGES <br /> A. Bidders should review the Contract Documents regarding limitations on claims for damages. <br /> 1.31 DELAYS AND INTERFERENCE <br /> A. Bidders should review the Contract Documents regarding delays and interference. <br /> 1.32 BIDDER'S CHECK LIST <br /> A. The Bidder's attention is especially called to the following forms that must be executed in full a <br /> as required and submitted with the Bid. <br /> 1. Bid: Show the lump sum and unit price items in the space provided on the Bid Form. I <br /> 2.
