, <br /> 2 <br /> 900" <br /> 1,-- <br /> 74.000.41 <br /> ORDINANCE No. <br /> AN ORDINANCE Relating to Enforcement of No-Contact Orders Protecting Victims of <br /> Human Trafficking and Prostitution,Amending Ordinance No. 1234-86 As Amended <br /> (EMC 10.22.040). <br /> Whereas,the 2017 Washington State Legislature adopted new laws protecting victims of <br /> human trafficking and prostitution,which new laws include providing penalties for violation of a <br /> no-contact order protecting such victims; and <br /> Whereas,after nearly four years since the most recent update of Everett Municipal Code <br /> 10.22.040,there is a need to update those provisions of the Everett Municipal Code; and <br /> Whereas,the City of Everett has the power to provide for the punishment of all practices <br /> dangerous to public health or safety, and to make necessary for the preservation of public health, <br /> peace and good order and to provide for the punishment of all persons charged with violating any <br /> city ordinances; and <br /> Whereas,the Everett City Council deems it appropriate for the City of Everett criminal <br /> laws to incorporate corresponding State law,that the City of Everett may prosecute such crimes; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 4 of Ordinance No. 1234-86, as amended by Section 3 of Ordinance No. <br /> 1807-91, Section 3 of Ordinance No. 2291-98, Section 1 of Ordinance No. 2466-00, Section 2 of <br /> Ordinance No. 2919-06, Section 1 of Ordinance No. 3026-07, Section 1 of Ordinance No. 3140- <br /> 09, Section 11 of Ordinance No. 3234-11, and Section 6 of Ordinance No. 3354-13 (EMC <br /> 10.22.040)which reads as follows: <br /> Violation of order for protection—Penalties. <br /> A. Whenever an order is granted under Section 2, Chapter 84, Washington Laws of 2013, <br /> Chapter 7.90, 9A.46, 9.94A, 10.99, 26.09,26.10,26.26, 26.50 or 74.34 RCW, or there is a valid <br /> foreign protection order as defined in RCW 26.52.020, and the respondent or person to be <br /> restrained knows of the order, a violation of any of the following provisions of the order is a <br /> gross misdemeanor, except as provided in RCW 26.50.110(4) or 26.50.110(5): <br /> 1. The restraint provisions prohibiting acts or threats of violence against, or stalking of, a <br /> protected party, or restraint provisions prohibiting contact with a protected party; <br /> 2.
