• <br /> • <br /> • <br /> 1 <br /> 2 ; and <br /> 3 WHEREAS, the City Council of the City of Everett finds that private <br /> 4 haulers now provide satisfactory and cost effective solid waste collection <br /> 5 services for the residents, businesses and industries of the City of <br /> 6 Everett, but that there is a need to provide publicly-supported coordination <br /> 7 and administration of solid waste management, including recycling programs, <br /> 8 in the City; and <br /> 9 WHEREAS, to establish the public portion of said recycling and solid <br /> 10 waste programs and continue City involvement in solid waste management, it <br /> 11 is necessary to establish a City of Everett Solid Waste Management Utility <br /> 12 and to establish charges for said service; <br /> 13 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 14 Section 1 : The City of Everett Solid Waste Management Utility is <br /> 15 hereby established. Said utility is authorized to undertake all activities <br /> 16 authorized by law for garbage and solid waste management including recycling <br /> 17 operations; provided that said utility is not authorized to engage directly <br /> 18 in garbage and solid waste collection, except for hard-to-manage waste <br /> 19 and/or city-wide clean-up projects and programs as the Mayor deems necessary <br /> 20 to promote and facilitate reduction and recycling and disposal . <br /> 21 Section 2: The utility shall be under the direct management of the <br /> 22 Mayor using such staff and consultant services as the Mayor deems <br /> 23 appropriate. The Mayor is authorized to contract, as necessary, pursuant to <br /> 24 state law, for solid waste management services. Any permanent City staff <br /> 25 proposed for the Solid Waste Management Utility shall be identified in the <br /> 26 Personnel Ordinance. <br /> 27 Section 3: The 1988 budget for said utility shall be as previously <br /> 28 established in Fund 115 (Resource Recovery) . <br /> 29 Section 4: Rates and charges for said utility shall be as follows: <br /> 30 <br /> 31 <br /> 32 <br /> 2 <br />
