Upon the written request of the County, HUD may grant an exception <br /> to the provisions of paragraph (b) of this section on a case-by-case <br /> basis when it determines that such an exception will serve to further <br /> the purposes of the HOME Program and the effective and efficient <br /> administration of the County's HOME activities. The County may <br /> submit to HUD for its consideration a request for an exception only <br /> after the Agency has provided to the County the following: <br /> i. A disclosure of the nature of the conflict, accompanied by an <br /> assurance that there has been public disclosure of the conflict and <br /> a description of how the public disclosure was made; and <br /> ii. An opinion of the Agency's attorney that the interest for which the <br /> exception is sought would not violate state or local law. <br /> The County will review the request of the Agency and will submit the <br /> request for an exception to HUD if the request meets the criteria listed <br /> above. <br /> e. Factors to be Considered for Exceptions <br /> The factors to be considered by the County in determining whether to <br /> submit an exception request shall be the same as those considered by <br /> HUD in determining whether to grant a requested exception and are <br /> contained at 24 CFR § 92.356(e). <br /> 2. Conflict of Interest in HOME-Assisted Housing <br /> a. Applicability <br /> No officer, employee, agent or consultant of the Agency may occupy <br /> any HOME-assisted unit. <br /> b.
