ORDER in a form consistent with his or her findings. The CEASE <br /> AND DESIST ORDER may also contain a requirement that the <br /> violation be abated in the manner prescribed by the Violations <br /> Hearing Examiner. <br /> SECTION 3: <br /> That Section 4 of Ordinance No. 1383-87 (EMC 1 .20.040) which reads as <br /> follows: <br /> A. There is hereby created the office of Violations Hearing <br /> Examiner. <br /> B. Violations Hearing Examiner(s) shall be part-time and <br /> remunerated by personal service contract. <br /> C. The Violations Hearing Examiner(s) shall be appointed by <br /> the Mayor. <br /> D. Violations Hearing Examiner(s) shall be licensed to <br /> practice law in the state. <br /> E. The Violations Hearing Examiner will be responsible for <br /> presiding over all hearings on Notices of Violations as well as <br /> other additional administrative matters over which he/she may be <br /> requested to preside. <br /> F. The Violations Hearing Examiner shall have the power to: <br /> 1 . Administer oaths and affirmations, examine witnesses <br /> and receive evidence; <br /> 2. Issue subpoenas upon the request of any party. The • <br /> City Treasurer, his designated agent, the City <br /> Attorney and any officer authorized to enforce this <br /> ordinance are also authorized to issue subpoenas. <br /> When so required, the applicant for the subpoena <br /> shall show to the satisfaction of said individual the <br /> general relevance and reasonable scope of the <br /> evidence sought; <br /> 3. Rule on offers of proof and receive relevant evidence; <br /> 4. Regulate the course of the hearing, including <br /> imposition of penalties for disruption of the orderly <br /> process or refusal to comply with lawful orders of <br /> the Violations Hearing Examiner. <br /> 4 <br />
