ORDINANCE NO. 1770-91 An Ordinance of the City of Everett, amending the provisions of the City's Zoning Code, Ordinance No. 1671-89 as amended by Ordinance No. 1729-90 , relating to the definitions of "Family" and "Group Home" , and adding a new definition for the term "Disabled Person(s) . " WHEREAS, the provisions of the Fair Housing Act of 1988 include among those persons entitled to its protection the disabled, including recovering drug addicts and alcohol abusers; and WHEREAS, the Everett Zoning Code provides for group care homes for residential rehabilitation centers for alcohol and drug abusers among class II group homes thereby restricting their availability within certain zones of the City; and WHEREAS, the Planning Commission deems it appropriate to clarify that these provisions relate to persons currently abusing drugs and alcohol and not to recovering alcoholics and drug abusers living in consentual, residential settings; and WHEREAS, the Planning Commission deems it consistent with federal law that consentual residential arrangements be governed only by the density requirements of the Zoning Code. NOW, THERRFORE, THE CITY OF EVERETT DOES ORDAIN: Ser'tinn 1 . Section 4 .020.A.64 of Ordinance NO. 1671-89, as amended, which presently reads: Family means any number of persons related by blood, marriage or legal adoption and including foster children and exchange students living together as a single housekeeping unit. Family also means a group of not more than four related and unrelated adults and their related minor children, but not to exceed a total of eight related and unrelated persons, living together as a single not for profit housekeeping unit. For the purposes of of this definition, an adult is a person over the age of eighteen years old, and a minor child is a person under the age of eighteen years old.
