1 B. Where a nuisance exists, the City Attorney on behalf of the City <br /> 2 is authorized to institute injunction, mandamus, or other appropriate action <br /> 3 or proceeding to prevent the violation of this ordinance. <br /> 4 C. Notwithstanding paragraph B, the City Attorney is authorized to <br /> 5 apply to any court of competent jurisdiction for such court, upon hearing <br /> 6 and for cause shown, may grant a temporary or permanent injunction <br /> 7 restraining any person, firm and/or corporation from violating any provision <br /> 8 of this ordinance and compelling compliance herewith. The cost of such <br /> 9 action shall be taxed against the violator. <br /> 10 D. A conviction of any person, firm or corporation for violating <br /> 11 this ordinance shall not impede the authority granted in this section to the <br /> 12 City Attorney or City. <br /> 13 Section 12: Rules. <br /> 14 The City of Everett Fire Chief is hereby authorized to promulgate rules <br /> 15 for the interpretation and implementation of this ordinance. <br /> 16 Section 13: Third Party Liability. <br /> 17 It expressly the purpose of this ordinance to provide for and promote <br /> 18 the health, safety and welfare of the general public and not to create or <br /> 19 otherwise establish or designate any particular class or group of persons <br /> 20 who will or should be especially protected or benefited by the terms of this <br /> 21 ordinance. <br /> 22 It is the specific intent of these regulations to place the obligation <br /> 23 of complying with these regulations upon the permit applicant and any person <br /> 24 owning, operating or controlling any building or structure within its <br /> 25 scope. No provision nor term used in this ordinance is intended to impose <br /> 26 .ny duty whatsoever upon the City or any of its officers or employees for <br /> 27 hom the implementation or enforcement of this ordinance shall be <br /> 28 siscretionary and not mandatory. <br /> 29 Nothing in this ordinance is intended to be nor shall be construed to <br /> 30 reate or form the basis for any liability on the part of the City or its <br /> 31 officers, employees or agents, for any injury or damage resulting from the <br /> 32 <br /> 7 <br />
