• <br /> 1 ORDINANCE NO. I V.5.0— 91U <br /> 2 <br /> AN ORDINANCE regulating the Surface Water System within the City <br /> 3 of Everett. <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : DEFINITIONS. <br /> 7 The following words and phrases, when used in this section, shall have <br /> 8 the following meanings: <br /> 9 A. "Director" means the Director of Public Works or his/her designee. <br /> 10 B. "Pollution" means such contamination, or other alteration of the <br /> 11 physical , chemical or biological properties of surface waters including <br /> 12 change in temperature, taste, color, turbidity, or odor of the waters, or <br /> 13 such discharge of any liquid, gaseous, solid, radioactive, or other <br /> 14 substance into any surface waters as will or is likely to create a nuisance <br /> 15 or render such waters harmful , detrimental or injurious to the public <br /> 16 health, safety or welfare or to domestic, commercial , industrial , <br /> 17 agricultural , recreational , or other legitimate beneficial uses or to <br /> 18 livestock, wild animals, birds, fish or other aquatic life. <br /> 19 C. "Private system" means any element in the surface water system <br /> 20 which is not under City ownership or management. <br /> 21 D. "Surface water system" means the receiving bodies of water and <br /> 22 the facilities within the City, both public and private, naturally existing <br /> 23 and artificial , for storm and surface water drainage, conveyance, detention <br /> 24 and storage, and any facilities or processes therein, both public and <br /> 25 private, natural or artificial , which control the quantity or maintain or <br /> 26 improve the quality of storm and surface waters or deter pollution. The <br /> 27 surface water system includes, but is not limited to streets, sidewalks and <br /> 28 all public right-of-ways. <br /> 29 E. "Unsafe condition" means any condition or activities in the <br /> 30 surface water system on public or private premises which may cause pollution <br /> 31 or does or may impair or impede the operation or functioning of the surface <br /> 32 water system or which may cause damage thereto. <br />
