• <br /> • 4 <br /> 1 necessary expenses incurred by the City in carrying out the pollutant <br /> 2 abatement procedures, including the collection, removal , containment, <br /> 3 treatment or disposal of such materials. <br /> 4 Section 12: STOP WORK ORDERS PROCEDURE. <br /> 5 Whenever any private or public construction work is being done contrary <br /> 6 to the provisions of this ordinance or any regulation adopted hereunder, the <br /> 7 Director is authorized to order the work stopped under any City permit for <br /> 8 such work by notice in writing served on any person engaged in the doing or <br /> 9 causing of such work to be done, and any such person shall forthwith stop <br /> 10 such work until authorized by the Director to proceed with the work <br /> 11 Failure to comply with a Stop Work Order shall constitute a violation <br /> 12 of this ordinance. <br /> 13 Section 13: MAINTENANCE AND OPERATION OF PRIVATE SYSTEMS. <br /> 14 The responsibility of the City shall be limited to maintenance and <br /> 15 operation of the public facilities and the City assumes no responsibility <br /> 16 for maintenance and operation of private systems. All private systems shall <br /> 17 be maintained by the owner or operator thereof in a safe and proper <br /> 18 operating condition, and in compliance with all applicable requirements of <br /> 19 this ordinance and regulations and procedures adopted hereunder and all <br /> 20 orders of the Director provided hereunder. <br /> 21 Section 14: LIABILITY. <br /> 22 The Director and any other employee charged with the enforcement of <br /> 23 this ordinance, acting for the City in good faith and without malice in the <br /> 24 discharge of his/her duties shall not thereby render himself/herself liable <br /> 25 personally for any damages which may accrue to persons or property as a <br /> 26 result of any act required or by reason of any act or omission in the <br /> 27 discharge of such duties. <br /> 28 It is the intent of these regulations to provide for and promote the <br /> 29 health, safety and welfare of the general public, and not to create or <br /> 30 otherwise establish or designate any particular class or group of persons <br /> 31 who will or should be especially protected or benefited by the terms of <br /> 32 these regulations. <br /> 7 <br />
