• <br /> • <br /> 1 ORDINANCE NO. /75.3--96) <br /> 2 <br /> AN ORDINANCE amending the City's interim traffic mitigation <br /> 3 policy, Ordinance No. 1670-89. <br /> 4 <br /> 5 WHEREAS, the City Council finds that on December 27, 1989, it adopted <br /> 6 Ordinance No. 1670-89 as an interim traffic mitigation policy to be used for <br /> 7 reviewing the traffic impacts of projects subject to SEPA until the City <br /> 8 adopts a comprehensive traffic mitigation ordinance; and <br /> 9 WHEREAS, the City Council finds that based upon the City's experience <br /> 10 with the interim policy that the following amendments are needed; <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1 : That Section 3 of Ordinance No. 1670-89 which reads as <br /> 13 follows: <br /> 14 <br /> Section 3: Whenever in the opinion of the City Traffic <br /> 15 Engineer a proposed development, or other action subject to SEPA, <br /> will generate fifty (50) or more additional (new) peak hour <br /> 16 (inbound and outbound) trips to and from the site, said fifty <br /> (50) trips shall constitute a significant adverse impact which <br /> 17 must be mitigated and the Responsible Official or his/her <br /> designee as part of the SEPA review shall be provided by the <br /> 18 project proponent a written traffic impact analysis in accordance <br /> with this ordinance. The analysis shall include impacts for the <br /> 19 year the development is proposed to be completed and a future (5 <br /> year) horizon year, currently 1995. This analysis shall be paid <br /> 20 for by the project proponent, and shall be prepared by a licensed <br /> professional engineer with standing in the Institute of <br /> 21 Transportation Engineers. <br /> 22 <br /> be and the same is hereby amended to read as follows: <br /> 23 <br /> 24 Section 3: Any additional trips assigned to the <br /> transportation facility in accordance with Section 4 of this <br /> 25 ordinance are considered to have a significant adverse impact on <br /> it's operation and must be mitigated in accordance with Section 9 <br /> 26 of this ordinance. <br /> 27 The project proponent shall provide the Responsible <br /> Official or his/her designee as part of the SEPA review a written <br /> 28 Traffic Impact Analysis, hereinafter referred to as the "Traffic <br /> Analysis or analysis," in accordance with this ordinance when <br /> 29 either the proposed development will generate fifty (50) or more <br /> additional peak hour (inbound and outbound) trips or when deemed <br /> 30 necessary by the City's Traffic Engineer. The Traffic Analysis <br /> shall include impacts for the future (5 year) horizon year. The <br /> 31 City' s Traffic Engineer may require additional analysis, <br /> including the extension of the horizon year, for projects that <br /> 32 are built in phases, or designed to be built-out over a number of <br />
