• <br /> 1 ORDINANCE NO. / Ycgi--—96 <br /> 2 <br /> 3 AN ORDINANCE amending the Uniform Code for the Abatement of <br /> Dangerous Buildings, Ordinance No. 1610-89. <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1 : Section 203 of the Uniform Code for the Abatement of <br /> 7 <br /> Dangerous Buildings, 1988 Edition, which was amended in Section 2 of <br /> 8 <br /> Ordinance No. 1610-89 with the addition and insertion of the following: <br /> 9 <br /> 10 Any person, firm or corporation violating any provision of <br /> this code shall be deemed guilty of a misdemeanor and, upon <br /> 11 conviction thereof, shall be punishable by a fine not to exceed <br /> one thousand dollars ($1 ,000) or by imprisonment in jail not to <br /> 12 exceed ninety (90) days, or both fine and imprisonment. Each <br /> separate day or any portion thereof, during which any violation <br /> 13 of this Code occurs or continues, shall be deemed to constitute a <br /> separate offense and, upon conviction thereof, shall be <br /> 14 punishable as herein provided. The issuance or granting of a <br /> permit or approval of plans and specifications shall not be <br /> 15 deemed or construed to be a permit for, or an approval of, any <br /> violation of any of the provisions of this Code. No permit <br /> 16 presuming to give authority to violate or cancel the provisions <br /> of this Code shall be valid, except insofar as the work or use <br /> 17 which it authorized is lawful . <br /> 18 Sec.2O5(a) . General . In order to hear and decide appeals <br /> of orders, decisions or determinations made by the Building <br /> 19 Official relative to the application and interpretation of this <br /> code, there shall be and is hereby created a Board of Appeals <br /> 20 consisting of members who are qualified by experience and <br /> training to pass upon matters pertaining to building construction <br /> 21 and who are not employees of the jurisdiction. The Building <br /> Official shall be an ex officio member and shall act as secretary <br /> 22 to said board but shall have no vote upon any matter before the <br /> board. The Board of Appeals shall be appointed by the governing <br /> 23 body and shall hold office at its pleasure. The board shall <br /> adopt rules of procedures for conducting its business and shall <br /> 24 render all decisions and findings in writing to the appellant, <br /> with a duplicate copy to the building official . Appeals to the <br /> 25 board shall be processed in accordance with the provisions <br /> contained in Section 501 of this code. Copies of all rules and <br /> 26 regulations adopted by the board shall be delivered to the <br /> Building Official , who shall make them freely accessible to the <br /> 27 public. <br /> 28 <br /> Section 203 of the Uniform Code for the Abatement of Dangerous <br /> 29 <br /> Buildings, 1988 Edition, as adopted by reference in Ordinance No. 1610-89 is <br /> 30 <br /> hereby amended to read in its entirety as follows: <br /> 31 <br /> 32 <br />
