• 1 ORDINANCE NO. / Ycgi--—96 2 3 AN ORDINANCE amending the Uniform Code for the Abatement of Dangerous Buildings, Ordinance No. 1610-89. 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : Section 203 of the Uniform Code for the Abatement of 7 Dangerous Buildings, 1988 Edition, which was amended in Section 2 of 8 Ordinance No. 1610-89 with the addition and insertion of the following: 9 10 Any person, firm or corporation violating any provision of this code shall be deemed guilty of a misdemeanor and, upon 11 conviction thereof, shall be punishable by a fine not to exceed one thousand dollars ($1 ,000) or by imprisonment in jail not to 12 exceed ninety (90) days, or both fine and imprisonment. Each separate day or any portion thereof, during which any violation 13 of this Code occurs or continues, shall be deemed to constitute a separate offense and, upon conviction thereof, shall be 14 punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be 15 deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this Code. No permit 16 presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use 17 which it authorized is lawful . 18 Sec.2O5(a) . General . In order to hear and decide appeals of orders, decisions or determinations made by the Building 19 Official relative to the application and interpretation of this code, there shall be and is hereby created a Board of Appeals 20 consisting of members who are qualified by experience and training to pass upon matters pertaining to building construction 21 and who are not employees of the jurisdiction. The Building Official shall be an ex officio member and shall act as secretary 22 to said board but shall have no vote upon any matter before the board. The Board of Appeals shall be appointed by the governing 23 body and shall hold office at its pleasure. The board shall adopt rules of procedures for conducting its business and shall 24 render all decisions and findings in writing to the appellant, with a duplicate copy to the building official . Appeals to the 25 board shall be processed in accordance with the provisions contained in Section 501 of this code. Copies of all rules and 26 regulations adopted by the board shall be delivered to the Building Official , who shall make them freely accessible to the 27 public. 28 Section 203 of the Uniform Code for the Abatement of Dangerous 29 Buildings, 1988 Edition, as adopted by reference in Ordinance No. 1610-89 is 30 hereby amended to read in its entirety as follows: 31 32
