• <br /> is hereby amended to read: <br /> ! C. Lots Mad Nonconforming by Public Acquisition; Other <br /> ( Nonconforming Lots. <br /> 1 . Any lot which does not conform to the minimum lot area <br /> or minimum lot dimension requirements of this Ordinance as a <br /> result of a portion of such lot being acquired by a <br /> government agency for a public use or purpose, or any lot <br /> which does not conform to the minimum lot area or minimum <br /> lot dimension requirements of this Ordinance which is not <br /> suihject to the requirements of Snhsect i on IR_ORU.A shall be <br /> permitted to be developed with: <br /> 111! <br /> 'i a. Residential Zones - a single family dwelling <br /> j; b. Commercial and Industrial Zones - any use which is <br /> permitted by the zone in which the property is located. <br /> 2. All uses of such lots shall meet the following <br /> requirements: <br /> H a. The resultant area of the lot shall be at least <br /> one-half the minimum lot area required by the zone in <br /> which it is located, or five-thousand (5,000) square <br /> feet, whichever if greater. Lots which do not meet the <br /> minimum area requirement of this Subsection may be <br /> it <br /> considered for the uses provided by Subsection 1 of <br /> this paragraph using Review Process II .B and the <br /> general evaluation criteria listed in Subsection <br /> I I <br /> 41 . 150.0 of this Ordinance. <br /> b. After required setbacks are accounted for, the lot <br /> shall have a building area in which a rectangle having <br /> minimum dimensions of thirty (30) feet by forty (40) <br /> feet can be located. Lots which do not meet this <br /> building area requirement may be considered for the <br /> uses provided by Subsection 1 of this paragraph using <br /> ii Review Process II.B and the general evaluation criteria <br /> listed in Subsection 41 . 150.0 of this Ordinance. <br /> c. All other requirements of this Ordinance. <br /> SECTION 28: <br /> ( Subsection 39. 075 is added to Ordinance No. 1671-89 , to read: <br /> H39 . 075 Front Lot Line on Corner Sites with More than One Lot. <br /> �i A_ When a development site is comprised of more than one <br /> platted lot or parcel of land , the Planning Director shall <br /> determine which lot line is to be the front lot line. <br /> R_ Tn making the determination of front lot line the <br /> II Planning Director shall use the following criteria: <br /> ii <br /> 1 _ the orientation of the originally created lot or <br /> parcel lines. <br /> H ? _ the relationship of the proposed development to <br /> • <br /> existing topography, buildings, and development <br /> j patterns in the immediate vicinity. <br /> 1 _ the classification of the affected streets <br /> (arterial , collector, local , etc_ ) and how the <br /> application of "front lot line" would affect vehicular <br /> 11 <br /> ii <br /> 11 <br /> I!
