is hereby amended to read: <br /> 3 . Structures and Tmprnvements. The City may, using Review <br /> Process II .B, allow structures and improvements to be <br /> located within a buffer area established in Subsections <br /> 17 . 100 and 37 . 160.0 only under one of the following <br /> circumstances: <br /> a. For public roads, utility improvements and structures; <br /> b. For passive recreation improvements and structures, not <br /> to include decks, patios, docks, boathouses, utility sheds, <br /> or other buildings except as otherwise permitted or required <br /> under the Shoreline Master Program; <br /> c. When the setback buffer is being created as part of a <br /> wetland mitigation proposal; <br /> d. To allow for reasonable use of the property and shall be <br /> limited to the minimum necessary to allow for reasonable use <br /> of the property; <br /> e. When required to provide public access to the shoreline <br /> by an approved shoreline permit; or <br /> f. When part of a public park or public trail system. <br /> SECTION 27: <br /> Subsection 38.080.0 of Ordinance No. 1671-89, which reads: <br /> C. Lots Made Nonconforming by Public Acquisition; Other <br /> Nonconforming Lots. <br /> 1. Any lot which does not conform to the minimum lot area or <br /> minimum lot dimension requirements of this Ordinance as a <br /> result of a portion of such lot being acquired by a government <br /> agency for a public use or purpose, shall be permitted to be <br /> developed with: <br /> a. Residential Zones - a single family dwelling <br /> b. Commercial and Industrial Zones - any use which is <br /> permitted by the zone in which the property is located. <br /> 2 . All uses of such lots shall meet the following <br /> requirements: <br /> a. The resultant area of the lot is one-half the minimum <br /> lot area required by the zone in which it is located, or <br /> five-thousand (5,000) square feet, whichever if greater. <br /> Lots which do not meet the minimum area requirement of this <br /> Subsection may be considered for the uses provided by <br /> Subsection 1 of this paragraph using Review Process II .B and <br /> the general evaluation criteria listed in Subsection <br /> 41.150 .0 of this Ordinance. <br /> b. If, after required setbacks are accounted for, the lot <br /> has a building area in which a rectangle having minimum <br /> dimensions of thirty ( 30) feet by forty (40) feet can be <br /> located. Lots which do not meet this building area <br /> requirement may be considered for the uses provided by <br /> Subsection 1 of this paragraph using Review Process II .B and <br /> the general evaluation criteria listed in Subsection <br /> 41. 150.0 of this Ordinance. <br /> c. All other requirements of this Code. <br />
