1 if the kegs or containers are not identified in compliance with rules adopted by the Washington State liquor control board. 2 3 Section 5: Repealer. 4 EMC 10.43.030, part of Section 1 of Ordinance No. 1243-86, is hereby 5 repealed. 6 Section 6: Severability. 7 Should any section, subsection, paragraph, sentence, clause or phrase 8 of this ordinance or its application to any person or situation be declared 9 unconstitutional or invalid for any reason, such decision shall not affect 10 the validity of the remaining portions of this ordinance or its application 11 to any other person or situation. The City Council of the City of Everett 12 hereby declares that it would have adopted this ordinance and each section, 13 subsection, sentence, clause, phrase or portion thereof irrespective of the 14 fact that any one or more sections, subsections, sentences, clauses, phrases 15 or portions be declared invalid or unconstitutional . 16 Section 7: Savings. 17 The enactments of this ordinance shall not affect any case, proceeding, 18 appeal or other matter currently pending in any court or in any way modify 19 any right or liability, civil or criminal , which may be in existence on the 20 effective date of this ordinance. 21 Section 8: Third Party Liability. 22 It is expressly the purpose of this ordinance to provide for and 23 promote the health, safety and welfare of the general public and not to 24 create or otherwise establish or designate any particular class or group of 25 persons who will or should be especially protected or benefited by the terms 26 of this ordinance. 27 It is the specific intent of this ordinance that no provisions nor any 28 term used in this ordinance is intended to impose any duty whatsoever upon 29 the City or any of its officers or employees, for whom the implementation 30 and enforcement of this ordinance shall be discretionary and not mandatory. 31 32 5
