1 if the kegs or containers are not identified in compliance with <br /> rules adopted by the Washington State liquor control board. <br /> 2 <br /> 3 Section 5: Repealer. <br /> 4 EMC 10.43.030, part of Section 1 of Ordinance No. 1243-86, is hereby <br /> 5 repealed. <br /> 6 Section 6: Severability. <br /> 7 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 8 of this ordinance or its application to any person or situation be declared <br /> 9 unconstitutional or invalid for any reason, such decision shall not affect <br /> 10 the validity of the remaining portions of this ordinance or its application <br /> 11 to any other person or situation. The City Council of the City of Everett <br /> 12 hereby declares that it would have adopted this ordinance and each section, <br /> 13 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 14 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 15 or portions be declared invalid or unconstitutional . <br /> 16 Section 7: Savings. <br /> 17 The enactments of this ordinance shall not affect any case, proceeding, <br /> 18 appeal or other matter currently pending in any court or in any way modify <br /> 19 any right or liability, civil or criminal , which may be in existence on the <br /> 20 effective date of this ordinance. <br /> 21 Section 8: Third Party Liability. <br /> 22 It is expressly the purpose of this ordinance to provide for and <br /> 23 promote the health, safety and welfare of the general public and not to <br /> 24 create or otherwise establish or designate any particular class or group of <br /> 25 persons who will or should be especially protected or benefited by the terms <br /> 26 of this ordinance. <br /> 27 It is the specific intent of this ordinance that no provisions nor any <br /> 28 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 29 the City or any of its officers or employees, for whom the implementation <br /> 30 and enforcement of this ordinance shall be discretionary and not mandatory. <br /> 31 <br /> 32 <br /> 5 <br />
