1 4. Not allow any person under the age of twenty-one (21 ) to <br /> 2 consume the beverage except as provided by RCW 66.44.270; <br /> 3 5. Not remove, obliterate, or allow to be removed or <br /> obliterated, the identification required under rules <br /> adopted by the Washington State liquor control board; <br /> 4 <br /> 6. Not move, keep, or store the keg or its contents, except <br /> 5 <br /> for transporting to and from the distributor, at any place <br /> 6 other than that particular address declared on the receipt <br /> and declaration; and <br /> 7 7. Maintain a copy of the declaration and receipt next to or <br /> 8 adjacent to the keg or other container, in no event a <br /> distance greater than five (5) feet, and visible without a <br /> 9 physical barrier from the keg, during the time that the keg <br /> or other container is in the purchaser' s possession or <br /> control . <br /> 10 <br /> 11 Section 3: EMC 10.43.040, part of Section 1 of Ordinance No. 1243-86, <br /> 12 which reads as follows: <br /> 13 <br /> Penalty. <br /> 14 <br /> 15 The violation of any provisions of this chapter shall be a <br /> misdemeanor. <br /> 16 <br /> 17 is hereby amended to read as follows: <br /> 18 Penalties. <br /> 19 1 . Except as provided in subsection 2 of this section, <br /> 20 the violation of any provisions of this chapter is punishable by <br /> a fine of not more than five hundred dollars. <br /> 21 2. Except as provided in EMC 10.74.040A and EMC <br /> 22 10.74.060, a person who intentionally furnishes a keg or other <br /> container containing four or more gallons of malt liquor to a <br /> 23 minor is liable, on conviction, for a first offense for a penalty <br /> of not more than five hundred dollars, or for imprisonment for <br /> 24 not more than two months, or both; for a second offense for a <br /> penalty of not more than five hundred dollars or imprisonment for <br /> 25 not more than six months, or both; and for a third or subsequent <br /> offense for a penalty of not more than five hundred dollars or <br /> 26 imprisonment for more than one year, or both. <br /> 27 Section 4: A new section is hereby added to Ordinance No. 1243-86. to <br /> 28 be codified as EMC 10.43.025, to read as follows: <br /> 29 <br /> 30 Sale of Unidentified Kegs <br /> 31 It is unlawful for any person to sell or offer for sale <br /> kegs or other containers containing four gallons or more of malt <br /> 32 liquor to consumers who are not licensed under chapter 66.24 RCW <br /> 4 <br />
