• • • 1 ORDINANCE NO. /695- 90 2 AN ORDINANCE relating to short cutting (motor vehicles turning at 3 intersections by crossing private property) , adding a new section to Ordinance No. 459-77 (Model Traffic Ordinance - 4 EMC Chapter 46.36) . 5 6 THE CITY OF EVERETT DOES ORDAIN: 7 Section 1 : NEW SECTION ADDED. 8 A new section is hereby added to Ordinance No. 459-77, to read as 9 follows: 10 Short Cutting. 11 A. It shall be unlawful for the driver of a vehicle intending 12 to turn onto another street at an intersection, or at any point to make or attempt to make a right hand or left hand 13 turn by crossing over private property, except where necessary to avoid conflict with other traffic or in 14 compliance with law or the direction of a police officer or traffic control device. 15 B. Penalties. Violation of any of the provisions of this 16 section shall be a traffic infraction, and may be punished by a fine not to exceed two hundred fifty dollars ($250) . 17 18 Section 2: CODIFICATION. 19 Section 1 of this ordinance shall be codified as one additional section 20 to EMC Chapter 46.36. 21 Section 3: SEVERABILITY. 22 Should any section, subsection, paragraph, sentence, clause or phrase 23 of this ordinance or its application to any person or situation be declared 24 unconstitutional or invalid for any reason, such decision shall not affect 25 the validity of the remaining portions of this ordinance or its application • 26 to any other person or situation. The City Council of the City of Everett 27 hereby declares that it would have adopted this ordinance and each section, 28 subsection, sentence, clause, phrase or portion thereof irrespective of the 29 fact that any one or more sections, subsections, sentences, clauses, phrases 30 or portions be declared invalid or unconstitutional . 31 32
