• <br /> • <br /> • <br /> 1 ORDINANCE NO. /695- 90 <br /> 2 <br /> AN ORDINANCE relating to short cutting (motor vehicles turning at <br /> 3 intersections by crossing private property) , adding a new <br /> section to Ordinance No. 459-77 (Model Traffic Ordinance - <br /> 4 EMC Chapter 46.36) . <br /> 5 <br /> 6 THE CITY OF EVERETT DOES ORDAIN: <br /> 7 Section 1 : NEW SECTION ADDED. <br /> 8 A new section is hereby added to Ordinance No. 459-77, to read as <br /> 9 follows: <br /> 10 <br /> Short Cutting. <br /> 11 <br /> A. It shall be unlawful for the driver of a vehicle intending <br /> 12 to turn onto another street at an intersection, or at any <br /> point to make or attempt to make a right hand or left hand <br /> 13 turn by crossing over private property, except where <br /> necessary to avoid conflict with other traffic or in <br /> 14 compliance with law or the direction of a police officer or <br /> traffic control device. <br /> 15 <br /> B. Penalties. Violation of any of the provisions of this <br /> 16 section shall be a traffic infraction, and may be punished <br /> by a fine not to exceed two hundred fifty dollars ($250) . <br /> 17 <br /> 18 Section 2: CODIFICATION. <br /> 19 Section 1 of this ordinance shall be codified as one additional section <br /> 20 to EMC Chapter 46.36. <br /> 21 Section 3: SEVERABILITY. <br /> 22 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 23 of this ordinance or its application to any person or situation be declared <br /> 24 unconstitutional or invalid for any reason, such decision shall not affect <br /> 25 the validity of the remaining portions of this ordinance or its application <br /> • <br /> 26 to any other person or situation. The City Council of the City of Everett <br /> 27 hereby declares that it would have adopted this ordinance and each section, <br /> 28 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 29 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 30 or portions be declared invalid or unconstitutional . <br /> 31 <br /> 32 <br />
