1 ORDINANCE NO. /4,94/- 90 <br /> 2 <br /> AN ORDINANCE relating to negligent operation of a vessel , <br /> 3 amending Everett Municipal Code 12.02.120 (contained within <br /> Section 1 of Ordinance No. 1246-86) . <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1 : Everett Municipal Code 12.02.120, contained within Section <br /> 7 <br /> 1 of Ordinance No. 1246-86, which reads as follows: <br /> 8 <br /> 9 Negligent Operation of Vessel . <br /> 10 It shall be unlawful for any person to operate a vessel in <br /> a negligent manner, except a commercial vessel which has or is <br /> 11 required to have valild marine document as a vessel of the United <br /> States and is operating in the navigable waters of the United <br /> 12 States. For the purpose of this section, to "operate in a <br /> negligent manner" shall be construed to mean the operation of a <br /> 13 vessel in such manner as to endanger or be likely to endanger any <br /> persons or property. <br /> 14 <br /> A violation of this section is a misdemeanor, punishable by <br /> 15 up to ninety (90) days in jail and by a fine of not more than One <br /> Thousand Dollars ($1 ,000) . In addition, the court may order the <br /> 16 defendant to pay restitution for any damages or injuries <br /> resulting from the offense. <br /> 17 <br /> 18 is hereby amended to read as follows: <br /> 19 <br /> Negligent Operation of Vessel . <br /> 20 <br /> It shall be unlawful for any person to operate a vessel in <br /> 21 a negligent manner. For the purpose of this section, to "operate <br /> in a negligent manner" shall be construed to mean the operation <br /> 22 of a vessel in such manner as to endanger or be likely to <br /> endanger any persons or property. <br /> 23 <br /> A violation of this section is a misdemeanor, punishable by <br /> 24 up to ninety (90) days in jail and by a fine of not more than One <br /> Thousand Dollars ($1 ,000) .
