The City Council of the City of Everett <br /> 2 hereby declares that it would have adopted this ordinance and each section, <br /> 3 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 4 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 5 or portions be declared invalid or unconstitutional . <br /> 6 Section 3: Third Party Liability. <br /> 7 It is expressly the purpose of this ordinance to provide for and <br /> 8 promote the health, safety and welfare of the general public and not to <br /> 9 create or otherwise establish or designate any particular class or groups of <br /> 10 persons who will or should be especially protected or benefitted by the <br /> 11 terms of this ordinance. <br /> 12 It is the specific intent of this ordinance that no provisions nor any <br /> 13 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 14 the City or any of its officers or employees, for whom the implementation <br /> 15 and enforcement of this ordinance shall be discretionary and not mandatory. <br /> 16 Nothing contained in this ordinance is intended nor shall be construed <br /> 17 to create or form the basis of any liability on the part of the City, or its <br /> 18 officers, employees or agents, for any injury or damage resulting from any <br /> 19 action or inaction on the part of the City related in any manner to the <br /> 20 enforcement of this ordinance by its officers, employees or agents. <br /> 21 <br /> 22OAS4001111101 / <br /> 23 <br /> 24 ATTEST: <br /> 2ier 4.1, A . <br /> 26 Passed: 5//6190 <br /> 27 Valid: 51/‘ /90 <br /> 28 Published: S/-13/90 <br /> 29 (0100) <br /> 30 <br /> 31 <br /> 32 <br /> 2 <br />
