2 . Lighting of the parking lots shall be a minimum <br /> of 1 to 2 foot candles. <br /> 3 . Light standards must be constructed with <br /> reflectors/shields to minimize light intrusion <br /> into the native forest area. <br /> MUKILTEO SCHOOL DISTRICT <br /> Prior to issuance of occupancy permits for any phase, as <br /> voluntary mitigation pursuant to RCW Chapter 82.02 , the <br /> Owner shall provide to the Mukilteo School District the <br /> mitigation payment in the amount of $230,000, which is <br /> the amount to which the District and the Owner have <br /> agreed. In addition, the Applicant must donate 3 .9 acres <br /> of the property to the Mukilteo School District, <br /> providing the Mukilteo School District takes action to <br /> accept the property within six months of execution of the <br /> City Council Findings, Conclusions and Decision on the <br /> rezone of the site. <br /> AGENCIES WITH JURISDICTION <br /> Department of Wildlife: Hydraulic Project Approvals <br /> (HPA) may be required from the State Department of <br /> Wildlife for any activity within a stream channel and <br /> for construction of all outfalls to the streams. <br /> GENERAL <br /> The "Owner" agrees to inform all contractors for each <br /> phase of development of the provisions of this rezone <br /> contract including all pertinent conditions and <br /> requirements which must be met. <br /> 3. Legal Requirements <br /> The Owner and his successors, tenants, and assigns, shall <br /> comply with all City, State, and Federal laws and <br /> regulations applicable to the development, sale and <br /> maintenance of the subject property, and nothing herein <br /> shall be construed as superseding said laws and <br /> regulations. <br /> 4. Recording <br /> This agreement shall be filed in the records of the <br /> Snohomish County Auditor for the purpose of subjecting <br /> the property to the restrictions, conditions, and <br /> limitations herein set forth which are intended and shall <br /> have the force and effect of deed restrictions and shall <br /> be deemed to be covenants running with the land and <br /> binding upon the owners, their successors, tenants, and <br /> assigns. <br /> 5. Enforcement <br /> A. Any violation of this Agreement by the owner, his <br /> successors, tenants or assigns, shall be considered a <br /> violation of the Zoning Code of the City of Everett <br /> and shall be subject to all applicable penalties. <br /> B. Any violation of this Agreement is subject to the <br /> cease and desist order enforcement procedure as <br /> adopted by the City of Everett. <br /> C. Any building or structure set up, erected, built, <br /> moved or maintained, or any use of the property <br /> 24 <br />
