1 but are not limited to van/car pooling programs, incentives to encourage <br /> 2 mass transit ridership or other measures which in the opinion of the City <br /> 3 Traffic Engineer would lessen the traffic impact of the proposed development; <br /> 4 C. If a DNS is issued and the project receives City approval on all <br /> 5 non-transportation related issues, proceed with the project and implement <br /> 6 the measures to mitigate the adverse transportation impacts in accordance <br /> 7 with the analysis as approved by the City's Traffic Engineer; and/or <br /> 8 D. Enter into such other contractual arrangements including but not <br /> 9 limited to latecomer agreements or such other alternatives offered by the <br /> 10 project proponent which are satisfactory to the City having the effect of <br /> 11 mitigating identified adverse transportation impacts of the development. <br /> 12 Any agreements must be on forms approved by the City Attorney's Office. <br /> 13 Section 11 : In the event that the traffic impact analysis is not <br /> 14 required in accordance with Section 3 of this ordinance, the project <br /> 15 proponent shall mitigate the project's transportation impacts in accordance <br /> 16 with the provisions of this section. <br /> 17 For those development proposals or actions which are subject to SEPA <br /> 18 which will generate less than fifty (50) additional (new) peak hour (inbound <br /> 19 and outbound) trips to and from the site, a proponent shall be required to <br /> 20 pay a mitigation fee in an amount equal to Eighty Dollars ($80) for each <br /> 21 trip which the development will produce within a twenty-four (24) hour <br /> 22 period as determined in the 4th Edition of the Trip Generation Guidelines as <br /> 23 prepared by the Institute of Transportation Engineers. Any agreement to pay <br /> 24 in accordance with the provisions of this section shall be on a form <br /> 25 approved by the City Attorney's Office. Provided, if a project proponent <br /> 26 disputes the Eighty Dollar ($80) fee described herein, the proponent has the <br /> 27 option of having prepared at his/her own expense a traffic impact analysis <br /> 28 as described in this ordinance and as approved by the City's Traffic <br /> 29 Engineer and mitigate the transportation impacts in accordance with Sections <br /> 30 9(B) (1 ) and 9(B) (2) of this ordinance. <br /> 31 <br /> 32 <br /> 6 <br />
