• <br /> 1 Section 12: Payment of all fees shall be made prior to final plat <br /> 2 approval in the case of subdivisions and short subdivisions and in all other <br /> 3 cases it shall be prior to the issuance of any building permits. All fees <br /> 4 generated under this ordinance shall be identified to transportation system <br /> 5 facility improvements which require mitigation as a direct result of the <br /> 6 proposed development and may be expended all or in part on only such <br /> 7 improvements so identified. The fees shall be expended in all cases within <br /> 8 five (5) years of collection. Any fees not so expended shall be refunded <br /> 9 with interest at the rate applied to judgments to the property owners of <br /> 10 record at the time of the refund• however, if the <br /> payment is not expended <br /> 11 within five (5) years due to delay attributable to the project proponent, <br /> 12 the payment shall be refunded without interest. <br /> 13 Section 13: It is understood that this is an interim policy to be used <br /> 14 by the City while developing a comprehensive traffic mitigation ordinance. <br /> 15 It is further recognized that the mitigation required pursuant to this <br /> 16 Ordinance will not off-set all of the traffic impacts generated by any <br /> 17 particular development proposal . Consequently, as a result of the adoption <br /> 18 of subsequent policies and ordinances, the City may impose such additional <br /> 19 traffic mitigation requirements on development proposals which have <br /> 20 mitigated their traffic impacts pursuant to the requirements of this <br /> 21 ordinance as the City is legally permitted to do so. <br /> 22 Section 14: This ordinance does not affect nor in any way diminish a <br /> 23 project proponent's responsibility to pay for and install traffic, <br /> 24 pedestrian and roadway improvements along his/her frontage in accordance <br /> 25 with Chapter 13.68 Everett Municipal Code and traffic safety-related <br /> 26 improvements which may be required in accordance with traffic safety studies <br /> 27 required by the City Traffic Engineer. <br /> 28 Section 15: The primary purpose of this ordinance is regulation by <br /> 29 provision of adequate transportation facilities in accordance with the <br /> 30 City's adopted transportation policy.
