• 1 Section 16: The City's Traffic Engineer and Responsible Official are 2 hereby authorized to promulgate rules and regulations consistent with the 3 terms of this policy. 4 Section 17: This ordinance constitutes an additional SEPA policy to be 5 interpreted together with Ordinance No. 1348-87. 6 Section 18: The Council finds that this ordinance is necessary for the immediate preservation of the public peace, health and safety and the public 8 welfare. This ordinance shall remain in effect until December 31 , 1990. 9 Section 19: Severability 10 If any provision of this ordinance or its application to any person or 11 circumstance is held invalid, the remainder of this ordinance, or the 12 application of the provision to other persons or circumstances, shall not be 13 affected. 14 Section 20: Third Party Liability 15 This ordinance is intended to provide for and promote the health, 16 safety and welfare of the general public, and is not intended to create or 17 otherwise establish or designate any particular class or group of persons 18 who will or should be especially protected or benefited by the terms of this 19 ordinance. It is the specific intent of this ordinance to place the 20 obligation of complying with these regulations upon the development 21 proponent. 22 Nothing contained in this ordinance is intended to be nor shall be 23 construed to create or form the basis for any liability on the part of the 24 City, or its officers, employees or agents, for any injury or damage 25 resulting from the failure of a development proponent to comply with the 26 provisions of this ordinance, or by reason or in consequence of any 27 inspection, notice, order, certificate, permission or approval authorized or 28 issued or done in connection with the implementation or enforcement pursuant 29 to this ordinance, or by reason of any action or inaction on the part of the 30 City related in any manner to the enforcement of this ordinance by its 31 officers, employees or agents. 32 8
