• <br /> 1 Section 16: The City's Traffic Engineer and Responsible Official are <br /> 2 hereby authorized to promulgate rules and regulations consistent with the <br /> 3 terms of this policy. <br /> 4 Section 17: This ordinance constitutes an additional SEPA policy to be <br /> 5 interpreted together with Ordinance No. 1348-87. <br /> 6 Section 18: The Council finds that this ordinance is necessary for the <br /> immediate preservation of the public peace, health and safety and the public <br /> 8 welfare. This ordinance shall remain in effect until December 31 , 1990. <br /> 9 Section 19: Severability <br /> 10 If any provision of this ordinance or its application to any person or <br /> 11 circumstance is held invalid, the remainder of this ordinance, or the <br /> 12 application of the provision to other persons or circumstances, shall not be <br /> 13 affected. <br /> 14 Section 20: Third Party Liability <br /> 15 This ordinance is intended to provide for and promote the health, <br /> 16 safety and welfare of the general public, and is not intended to create or <br /> 17 otherwise establish or designate any particular class or group of persons <br /> 18 who will or should be especially protected or benefited by the terms of this <br /> 19 ordinance. It is the specific intent of this ordinance to place the <br /> 20 obligation of complying with these regulations upon the development <br /> 21 proponent. <br /> 22 Nothing contained in this ordinance is intended to be nor shall be <br /> 23 construed to create or form the basis for any liability on the part of the <br /> 24 City, or its officers, employees or agents, for any injury or damage <br /> 25 resulting from the failure of a development proponent to comply with the <br /> 26 provisions of this ordinance, or by reason or in consequence of any <br /> 27 inspection, notice, order, certificate, permission or approval authorized or <br /> 28 issued or done in connection with the implementation or enforcement pursuant <br /> 29 <br /> to this ordinance, or by reason of any action or inaction on the part of the <br /> 30 City related in any manner to the enforcement of this ordinance by its <br /> 31 officers, employees or agents. <br /> 32 <br /> 8 <br />
