1 ORDINANCE NO. /‘6 1 eF9' <br /> 2 <br /> AN ORDINANCE establishing licensing regulations for towing <br /> 3 businesses and tow trucks amending Ordinance No. 295-74 by <br /> the addition of a new chapter and repealing Ordinance No. <br /> 4 560-78 (Chapter 5.70 Everett Municipal Code) . <br /> 5 <br /> 6 WHEREAS, the City Council finds that in order to protect the health, <br /> 7 safety and welfare of the citizens of Everett there is a need to adopt <br /> 8 licensing regulations for tow truck operators; <br /> 9 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 Ordinance No. 295-74 is hereby amended by the addition of a new chapter <br /> 11 regulating towing businesses and tow trucks which chapter shall read as <br /> 12 follows: <br /> 13 Section 1 : DEFINITIONS. <br /> 14 A. "Towing business" or "towing service" includes any person, <br /> 15 corporation, partnership, joint venture or other business entity which owns <br /> 16 and/or operates one or more tow trucks within the corporate limits of the <br /> 17 City of Everett. <br /> 18 B. "Tow truck" means any vehicle designed or intended to tow <br /> 19 vehicles which are disabled by mechanical failure or physical damage or <br /> 20 being impounded pursuant to law. <br /> 21 C. "Impound" means the taking of a vehicle into legal custody, <br /> 22 pursuant to law. <br /> 23 D. "Police" means any authorized agent of the Everett Police <br /> 24 Department or other law enforcement agency having jurisdiction. <br /> 25 E. "Police Department" means the Police Department of the City of <br /> 26 Everett. <br /> 27 F. "City" means City of Everett. <br /> 28 G. "Licensee" means a towing service having a valid license issued <br /> 29 by the City of Everett authorizing the furnishing of towing services. <br /> 30 Section 2: LICENSE REQUIRED. <br /> 31 It is unlawful for any person, corporation, partnership, joint venture <br /> 32 <br />
