• <br /> • <br /> 1 <br /> 1 . Statements by an owner or by anyone in control of the <br /> 2 object concerning its use; <br /> 3 2. Prior convictions, if any, of an owner, or of anyone in <br /> control of the object, under any state or federal law <br /> 4 relating to any controlled substance; <br /> 5 3. The proximity of the object, in time and space, to a direct <br /> violation of this chapter; <br /> 6 <br /> 4. The proximity of the object to controlled substances; <br /> 7 <br /> 5. The existence of any residue of controlled substances on <br /> 8 the object; <br /> 9 6. Direct or circumstantial evidence of the intent of an <br /> owner, or of anyone in control of the object, to deliver it <br /> 10 to persons whom he knows, or should reasonably know, intend <br /> to use the object to facilitate a violation of this <br /> 11 chapter; the innocence of an owner, or of anyone in control <br /> of the object, as to a direct violation of this chapter <br /> 12 shall not prevent a finding that the object is intended or <br /> designed for use as drug paraphernalia; <br /> 13 <br /> 7. Instructions, oral or written, provided with the object <br /> 14 concerning its use; <br /> 15 8. Descriptive materials accompanying the object which explain <br /> or depict its use; <br /> 16 <br /> 9. National and local advertising concerning its use; <br /> 17 <br /> 10. The manner in which the object is displayed for sale; <br /> 18 <br /> 11 . Whether the owner, or anyone in control of the object, is a <br /> 19 legitimate supplier of like or related items to the <br /> community, such as a licensed distributor or dealer of <br /> 20 tobacco products; <br /> 21 12. Direct or circumstantial evidence of the ratio of sales of <br /> the object(s) to the total sales of the business enterprise; <br /> 22 <br /> 13. The existence and scope of legitimate uses for the object <br /> 23 in the community; and <br /> 24 14. Expert testimony concerning its use. <br /> 25 <br /> Section 2: Possession of Drug Paraphernalia. <br /> 26 <br /> It is unlawful for any person to use, or possess with intent to use, <br /> 27 <br /> drug paraphernalia to plant, propagate, cultivate, grow, harvest, <br /> 28 <br /> manufacture, compound, convert, produce, process, prepare, test, analyze, <br /> 29 <br /> pack, repack, store, contain, conceal , inject, ingest, inhale, or otherwise <br /> 30 <br /> introduce into the human body a controlled substance, as defined by RCW <br /> 31 <br /> Chapter 69.50, as now or hereafter amended. Any person who violates this <br /> 32 <br /> section is guilty of a misdemeanor. <br /> 3 <br />
