<br /> 1 Section 3: Manufacture or Delivery of Drug Paraphernalia.
<br /> 2 It is unlawful for any person to deliver, possess with intent to
<br /> 3 deliver, or manufacture with intent to deliver drug paraphernalia, knowing,
<br /> 4 or under circumstances where one reasonably should know, that it will be
<br /> 5 used to plant, propagate, cultivate, grow, harvest, manufacture, compound,
<br /> 6 convert, produce, process, prepare, test, analyze, pack, repack, store,
<br /> 7 contain, conceal , inject, ingest, inhale, or otherwise introduce into the
<br /> 8 human body a controlled substance, as defined by RCW Chapter 69.50, as now
<br /> 9 or hereafter amended. Any person who violates this section is guilty of a
<br /> 10 misdemeanor.
<br /> 11 Section 4: Delivery of Drug Paraphernalia to a Minor.
<br /> 12 Any person eighteen (18) years of age or over who violates Section 3 of
<br /> 13 this ordinance by delivering drug paraphernalia to a person under eighteen
<br /> 14 (18) years of age who is at least three (3) years his junior is guilty of a
<br /> 15 gross misdemeanor.
<br /> 16 Section 5: Advertisement of Drug Paraphernalia.
<br /> 17 It is unlawful for any person to place in any newspaper, magazine,
<br /> 18 handbill , or other publication any advertisement, knowing, or under
<br /> 19 circumstances where one reasonably should know, that the purpose of the
<br /> 20 advertisement, in whole or in part, is to promote the sale of objects
<br /> 21 designed or intended for use as drug paraphernalia. Any person who violates
<br /> 22 this section is guilty of a misdemeanor.
<br /> 23 Section 6: Possession of Marihuana.
<br /> 24 A. Any person who possesses forty (40) grams or less of marihuana
<br /> 25 shall be guilty of a misdemeanor.
<br /> 26 B. "Marihuana" means all parts of the plant of the genus Cannabis
<br /> 27 L. , whether growing or not; seeds thereof; the resin extracted from any part
<br /> 28 of the plant; and every compound, manufacture, salt, derivative, mixture, or
<br /> 29 preparation of the plant, its seeds or resin. It does not include the
<br /> 30 mature stalks of the plant, fiber produced from the stalks, oil or cake made
<br /> 31 from the seeds of the plant, any other compound, manufacture, salt,
