<br /> Section 2: Section 3 of Ordinance No. 2129-96 (EMC 8.56.030), which reads as follows:
<br /> Definitions.
<br /> The following definitions are applicable in this chapter unless the context otherwise
<br /> requires:
<br /> A. "Camp"means to pitch or occupy camp facilities; to use camp paraphernalia.
<br /> B. "Camp facilities" include,but are not limited to, tents, huts, or temporary shelters.
<br /> C. "Camp paraphernalia"includes, but is not limited to, tarpaulins, cots,beds,
<br /> sleeping bags, hammocks or non-city designated cooking facilities and similar
<br /> equipment.
<br /> D. "Park"means the same as defined in EMC 9.06.020.
<br /> E. "Store"means to put aside or accumulate for use when needed, to put for
<br /> safekeeping, to place or leave in a location.
<br /> F. "Street"means any highway, lane, road, street, right-of-way,boulevard, alley, and
<br /> every way or place in Everett open as a matter of right to public vehicular travel.
<br /> Be and the same is hereby amended to read as follows:
<br /> A. "Camp"means to pitch, use, or occupy camp facilities for the purposes of
<br /> habitation, as evidenced by the use of camp paraphernalia.
<br /> B. "Camp facilities"include,but are not limited to, tents, huts, temporary shelters, or
<br /> vehicles if said vehicle is being used as a temporary living quarters.
<br /> C. "Camp paraphernalia" includes, but is not limited to, tarpaulins, cots, beds,
<br /> sleeping bags,blankets, mattresses, hammocks or cooking facilities or equipment.
<br /> D. "Park"means the same as defined in EMC 9.06.020.
<br /> E. "Store"means to put aside or accumulate for use when needed, to put for
<br /> safekeeping, to place or leave in a location.
<br /> F. "Street"means any highway, lane, road, street, right-of-way,boulevard, alley, and
<br /> every way or place in Everett open as a matter of right to public vehicular travel.
<br /> Section 3: General duty.
<br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety
<br /> and welfare of the general public and not to create or otherwise establish or designate any
<br /> particular class or group of persons who will or should be especially protected or
<br /> benefited by the terms of this ordinance. It is the specific intent of this ordinance that no
<br /> provision nor any term used in this ordinance is intended to impose any duty whatsoever
<br /> upon the city or any of its officers or employees. Nothing contained in this ordinance is
<br /> intended nor shall be construed to create or form the basis of any liability on the part of
<br /> the city, or its officers, employees or agents, for any injury or damage resulting from any
<br /> action or inaction on the part of the city related in any manner to the enforcement of this
<br /> ordinance by its officers, employees or agents.
