Article 9 <br /> Representative of the Parties / Key Personnel <br /> 9.1 Owner's Representatives <br /> 9.1.1 Owner designates the individual listed below as its Senior Representative ("Owner's <br /> Senior Representative"), which individual has the authority and responsibility for resolving <br /> disputes under Section 10.7.2 of the General Conditions of Contract: <br /> James W. Miller, Engineering Superintendent, 3200 Cedar St, Everett, WA 98201 <br /> 9.1.2 Owner designates the individual listed below as its Owner's Representative, which <br /> individual has the authority and responsibility set forth in Section 3.3 of the General Conditions of <br /> Contract: <br /> Richard Hefti, Project Manager, 3200 Cedar St, Everett, WA 98201 <br /> 9.2 Design-Builder's Representatives <br /> 9.2.1 Design-Builder designates the individual listed in the table in Section 9.3 below as its <br /> Senior Representative ("Design-Builder's Senior Representative"), which individual has the <br /> authority and responsibility for avoiding and resolving disputes under Section 10.7.2 of the <br /> General Conditions of Contract: <br /> 9.2.2 Design-Builder designates the individual listed in the table in Section 9.3 below as its <br /> Design-Builder's Representative, which individual has the authority and responsibility set forth in <br /> Section 2.1.1 of the General Conditions of Contract: <br /> 9.3 Key Personnel Design-Builder agrees to provide all professional personnel necessary, at <br /> adequate staffing levels, to perform the required services under this Contract, including the key personnel <br /> identified below: <br /> Position Title Name of Individual <br /> Design-Builder Senior Representative Justin Rawls-T Bailey, Inc <br /> Design-Builder Representative (Project Dan Mahoney-T Bailey, Inc <br /> Manager) <br /> Design-Builder Clearwell Roof Design Mgr Ron Kern, PE, SE-Ultraflote LLC <br /> Design-Builder Superintendent Ron Parker/Scott Lavelle-T Bailey, Inc <br /> Design-Builder Structural Engineering Mgr Erik Martin, PE, SE, Principle-Sargent Engineers, Inc <br /> These key personnel, all of whom were named in Design-Builder proposal submitted in response <br /> to the Owner's Request for Qualifications and Proposals for the Project, will be assigned to the Project. <br /> Except in the event of the death of the employee or their termination of employment with Design-Builder, <br /> these key personnel shall remain assigned for the duration of the Project unless otherwise agreed to in <br /> writing by the Owner in its sole discretion. In the event Design-Builder proposes to substitute any of the <br /> key personnel designated below due to death or employment termination, the individual(s) proposed must <br /> demonstrate the qualifications indicated in the Request for Proposals for their respective role(s), and <br /> experience as required to successfully perform such duties. Owner shall have the sole right to determine <br /> whether key personnel proposed as substitutes are qualified to work on the Project. Design-Builder will <br /> remove from the Project any personnel assigned to the Project if, after the matter has been thoroughly <br /> considered by Owner and Design-Builder, Owner considers such removal necessary and in the best <br /> interest of the Project, and Owner so notifies Design-Builder in writing and allows a reasonable period of <br /> time for the transition to different personnel. <br /> City of Everett—Contract Page 10 <br /> Between Owner and Design Builder—Lump Sum <br /> East Clearwell Roof Replacement Project <br />
