' I • <br /> 10.1.5 Subcontractors. Except as otherwise agreed by the Owner in writing: the Design- <br /> Builder shall furnish separate evidence of insurance as stated above for each Subcontractor; and <br /> all coverage for Subcontractors shall be subject to all requirements stated herein (including <br /> specifically that the Owner be named as an additional insured on such insurance) *See RFP Addendum #1, <br /> Pg. 2. <br /> 10.2 Design-Builder's Bonds and Other Performance Security. Design-Builder shall provide the <br /> following performance bond and labor and material payment bond or other performance security: <br /> 10.2.1 Performance and Payment Bond. Design-Builder shall secure from a surety company <br /> acceptable to Owner, admitted and licensed in the State of Washington, and shall pay for <br /> performance and payment bonds covering the faithful performance of the Contract and payment <br /> of obligations arising under the Contract Documents (except those performance and payment <br /> obligations covered by the roof warranty bond described in Section 10.2.2 below), each in the full <br /> amount of the Contract Price plus sales tax, pursuant to RCW 39.08, "Contractor's Bond." The <br /> bond shall be on a form provided by Owner. The bond must be executed by a duly licensed <br /> surety company that is listed in the latest Circular 570 of the United States Treasury Department <br /> as being acceptable as surety on federal bonds. No surety's liability on the bond shall exceed the <br /> underwriting limitations for the respective surety specified in Circular 570. The scope of the bond <br /> or the form thereof prescribed in these Contract Documents shall in no way affect or alter the <br /> liabilities of Design-Builder to Owner as set forth herein. All bonds signed by an agent or <br /> attorney-in-fact must be accompanied by a certified copy of that individual's authority to bind the <br /> surety. The evidence of authority shall show that it is effective on the date the agent or attorney- <br /> in-fact signed each bond. The bond shall cover all Change Orders without further consent from <br /> the surety. <br /> 10.2.2 Roof Warranty Bond. Design-Builder shall secure a warranty bond for the extended <br /> roof warranty as required by the Contract Documents. <br /> 10.3 Builder's Risk Insurance. Design-Builder shall provide property insurance under an "All Risk <br /> Builder's Risk" form in an amount equal to the full insurable value of the Work, inclusive of earthquake <br /> and flood, subject to customary industry deductibles. <br /> Article 11 <br /> Other Provisions <br /> 11.1 CPARB Reporting. Design-Builder shall provide the Owner and the Capital Projects Advisory <br /> Review Board (CPARB) any project information required to be submitted by the Design-Builder in <br /> accordance with the provisions of Chapter 39.10 RCW and the requirements of CPARB. <br /> 11.2 Furnishing of Services and Information. Subject to the Supplementary Conditions, Owner <br /> shall provide the following to Design-Builder: <br /> 11.2.1 Site map, including access points and areas of restricted access. <br /> 11.2.2 As-built and record drawings for the East Clearwell. These may be relied on for <br /> demolition purposes only. Design-Builder shall not rely on these as-built or record drawings with <br /> respect to the fabrication or installation of the new roof. Design-Builder is 100% responsible for <br /> ascertaining and verifying all relevant facts with respect to the fabrication and installation of the <br /> new roof. <br /> 11.2.3 Roof Assessment Report by CG Engineering dated December 7, 2016, regarding East <br /> Clearwell Roof to be demolished. Design-Builder is responsible for the proper removal and <br /> disposal of all Hazardous Conditions shown in the report within the to-be-demolished structure, <br /> without adjustment to Contract Time or Contract Price. <br /> 11.2.4 Geotechnical reports that have been completed previously in the vicinity of the East <br /> City of Everett—Contract Page 13 <br /> Between Owner and Design Builder—Lump Sum <br /> East Clearwell Roof Replacement Project <br />
