1 WHEREAS, the City Council finds that the adoption and enforcement of 2 the Model Conservation Standards for applicable electrically heated and/or 3 conditioned buildings promotes the public health, safety and general welfare 4 of the citizens of Everett; 5 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : 7 (a) The Model Conservation Standards Equivalent Code Amendments to the Model Energy Code (i .e. : "Northwest Energy Code," June 1987 8 Edition (consisting of Chapters 1 through 10) as now existing and in accordance with any amendments that may be made thereto) ; for 9 application with respect to: (1 ) new residential construction using electrical space heating; (2) new commercial buildings 10 using electric space conditioning and electric lighting (except that commerical buildings which are not electrically space 11 conditioned shall only be required to comply with Section 505 of said Northwest Energy Code and provided that, for commercial 12 buildings, ventilation requirements contained in Section 305 of the Washington State Energy Code shall be the applicable 13 standard) ; and 14 (b) The "Conversion Standard Equivalent Code Amendments to the Model Energy Code," December 24, 1986, Edition, as now existing and in 15 accordance with any amendments that may be made thereto, for application with respect to: any buildings constructed pursuant 16 to a building permit issued from and after the effective date of this ordinance, which at the time of initial construction were 17 not required to comply with the Model Conservation Standards as set forth above in subsection (a) but which are subsequently 18 being converted to provide electric space heating or conditioning; and 19 (c) Additional indoor air quality requirements as set forth in 20 Bonneville Power Administration's Solicitation No. DE PS79 89BP93000, as now existing and in accordance with any 21 amendments that may be made thereto, 22 are hereby adopted by reference; provided, however, that once the foregoing 23 subsections (a), (b) and (c ) of this section become effective they shall 24 remain effective only for and during such period as the City has in effect a 25 contract with the Bonneville Power Administration or other appropriate 26 agency which reimburses the City for incremental costs and/or administrative 27 enforcement costs associated with the adoption, administration, and 28 enforcement of subsections (a) , (b) and (c) of this section. 29 Section 2: Section 107 of the Model Consevation Standards Equivalent 30 Code Amendments to the Model Energy Code, June 1987 Edition, and any 31 subsequent revisions as promulgated by the Bonneville Power Administration 32 which is entitled "Violations" and which reads as follows: 2
