1 WHEREAS, the City Council finds that the adoption and enforcement of <br /> 2 the Model Conservation Standards for applicable electrically heated and/or <br /> 3 conditioned buildings promotes the public health, safety and general welfare <br /> 4 of the citizens of Everett; <br /> 5 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : <br /> 7 (a) The Model Conservation Standards Equivalent Code Amendments to <br /> the Model Energy Code (i .e. : "Northwest Energy Code," June 1987 <br /> 8 Edition (consisting of Chapters 1 through 10) as now existing and <br /> in accordance with any amendments that may be made thereto) ; for <br /> 9 application with respect to: (1 ) new residential construction <br /> using electrical space heating; (2) new commercial buildings <br /> 10 using electric space conditioning and electric lighting (except <br /> that commerical buildings which are not electrically space <br /> 11 conditioned shall only be required to comply with Section 505 of <br /> said Northwest Energy Code and provided that, for commercial <br /> 12 buildings, ventilation requirements contained in Section 305 of <br /> the Washington State Energy Code shall be the applicable <br /> 13 standard) ; and <br /> 14 (b) The "Conversion Standard Equivalent Code Amendments to the Model <br /> Energy Code," December 24, 1986, Edition, as now existing and in <br /> 15 accordance with any amendments that may be made thereto, for <br /> application with respect to: any buildings constructed pursuant <br /> 16 to a building permit issued from and after the effective date of <br /> this ordinance, which at the time of initial construction were <br /> 17 not required to comply with the Model Conservation Standards as <br /> set forth above in subsection (a) but which are subsequently <br /> 18 being converted to provide electric space heating or <br /> conditioning; and <br /> 19 <br /> (c) Additional indoor air quality requirements as set forth in <br /> 20 Bonneville Power Administration's Solicitation No. <br /> DE PS79 89BP93000, as now existing and in accordance with any <br /> 21 amendments that may be made thereto, <br /> 22 are hereby adopted by reference; provided, however, that once the foregoing <br /> 23 subsections (a), (b) and (c ) of this section become effective they shall <br /> 24 remain effective only for and during such period as the City has in effect a <br /> 25 contract with the Bonneville Power Administration or other appropriate <br /> 26 agency which reimburses the City for incremental costs and/or administrative <br /> 27 enforcement costs associated with the adoption, administration, and <br /> 28 enforcement of subsections (a) , (b) and (c) of this section. <br /> 29 Section 2: Section 107 of the Model Consevation Standards Equivalent <br /> 30 Code Amendments to the Model Energy Code, June 1987 Edition, and any <br /> 31 subsequent revisions as promulgated by the Bonneville Power Administration <br /> 32 which is entitled "Violations" and which reads as follows: <br /> 2 <br />
