1 ORDINANCE NO. / �g/-1f 2 AN ORDINANCE relating to theft of cable television services, 3 adding new sections to Article 8 of Ordinance No. 1145-85 (EMC Chapter 10.56) . 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : 7 A. A person is guilty of theft of cable television services if: 8 1 . With intent to avoid payment of the lawful charge for 9 any communication service of a cable system, he or she: 10 a. tampers with the equipment of the cable system, 11 whether by mechanical , electrical , acoustical , or other means; or 12 b. knowingly misrepresents a material fact; or 13 c. uses any other artifice, trick, deception, 14 code, or other device; and 15 2. He or she wrongfully obtains cable communication services for himself or herself or another. 16 17 B. Sections 1 through 3 of this ordinance do not apply to the 18 interception or receipt by any individual or the assisting (including the 19 manufacture or sale) , of such interception or receipt of any 20 satellite-transmitted programming for private use. 21 C. Theft of cable television services is a gross misdemeanor. 22 Section 2: 23 A. A person is guilty of unlawful sale of cable television services 24 if, with intent to avoid payment of the lawful charge for any communications 25 services of a cable system, he or she offers for sale or otherwise makes 26 available any telecommunications decoder or descrambler that defeats a 27 mechanism of electronic signal encryption, or that restricts delivery of 28 individually addressed switching imposed by the cable system. 29 B. Unlawful sale of cable television services is a gross misdemeanor. 30 Section 3: 31 Upon conviction of theft or unlawful sale of cable television services 32 and upon motion and hearing, the court shall order the forfeiture of any
