1 decoder, descrambler, or other device used in committing the violation of <br /> 2 Section 1 or 2 of this ordinance as contraband and dispose of it at the <br /> 3 court's discretion. <br /> 4 Section 4: <br /> 5 No person may be charged with theft under Section 1 of this ordinance <br /> 6 for connecting a nondecoding or nondescrambling channel frequency converter, <br /> 7 which includes cable-ready television sets, video recorders, or similar <br /> 8 equipment, to a cable system. <br /> 9 Section 5: Codification. <br /> 10 Sections 1 through 4 of this ordinance shall be codified as four <br /> 11 additional sections of EMC Chapter 10.56. <br /> 12 Section 6: Severability. <br /> 13 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 14 of this ordinance or its application to any person or situation be declared <br /> 15 unconstitutional or invalid for any reason, such decision shall not affect <br /> 16 the validity of the remaining portions of this ordinance or its application <br /> 17 to any other person or situation. The City Council of the City of Everett <br /> 18 hereby declares that it would have adopted this ordinance and each section, <br /> 19 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 20 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 21 or portions be declared invalid or unconstitutional . <br /> 22 Section 7: Third Party Liability. <br /> 23 It is expressly the purpose of this ordinance to provide for and <br /> 24 promote the health, safety and welfare of the general public and not to <br /> 25 create or otherwise establish or designate any particular class or group of <br /> 26 persons who will or should be especially protected or benefited by the terms <br /> 27 of this ordinance. <br /> 28 It is the specific intent of this ordinance that no provisions nor any <br /> 29 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 30 the City or any of its officers or employees, for whom the implementation <br /> 31 and enforcement of this ordinance shall be discretionary and not mandatory. <br /> 32 <br /> 2 <br />
