• <br /> • <br /> 1 revocation/suspension will not be effective until the City <br /> 2 Clerk makes a determination following the hearing. <br /> 3 D. Notwithstanding subsection C herein, a license <br /> suspension/revocation shall become effective immediately <br /> 4 without the benefit of any pre-suspension/revocation <br /> hearing when the ordinance requires a summary <br /> revocation/suspension or when the City Clerk determines <br /> that it is in the best interest of the health and/or safety <br /> 6 of the citizens of Everett to do so. <br /> 7 E. Within ten (10) days following the date of revocation or <br /> suspension of any license issued pursuant to this <br /> 8 ordinance, or within ten (10) days following the date of <br /> denial of any license regulated by this ordinance, an <br /> 9 appeal may be filed with the City 's Parking Hearing <br /> Examiner. Upon the timely filing of an appeal , the <br /> 10 licensee shall be afforded a hearing before the City's <br /> Parking Hearing Examiner after notice as provided herein <br /> 11 has been given. Said appeal shall be in writing and <br /> addressed to the City's Parking Hearing Examiner, <br /> 12 "ATTENTION: City Clerk." Notice of the time and date of <br /> such appeal hearing shall be given by delivering a copy of <br /> 13 the notice to the holder of the license or by mailing a <br /> copy thereof to the holder at his last address as shown by <br /> 14 the City Clerk 's license records which notice shall be <br /> mailed or delivered at least five (5) days before the date <br /> 15 fixed for the hearing. The City's Parking Hearing Examiner <br /> shall , within thirty (30) days after the conclusion of such <br /> 16 hearing, issue a decision as to the revocation, suspension <br /> or denial . Such decision of the City's Parking Hearing <br /> 17 Examiner shall be final and conclusive as of the date set <br /> forth in the decision, unless within fifteen (15) days from <br /> 18 the effective date of the City 's Parking Hearing Examiner's <br /> order an aggrieved person or persons obtain a writ of <br /> 19 certiorari from the Superior Court of Washington for <br /> Snohomish County for purpose of review of the action taken. <br /> 20 <br /> It is unlawful for any person whose license has been <br /> 21 revoked or suspended, to keep the license issued to him/her <br /> in his/her possession or under his control , and the same <br /> 22 shall immediately be surrendered to the City Clerk. When <br /> revoked, the license shall be cancelled, and when suspended <br /> 23 the City Clerk shall retain the same during the period of <br /> suspension. <br /> 24 <br /> 25 Section 2: That Section 13 of Ordinance No. 1400-87 (EMC 5.68.150) <br /> 26 which reads as follows: <br /> 27 Section 13: DRIVER'S LICENSE - QUALIFICATIONS <br /> 28 <br /> A. A for-hire driver's license will be denied unless the <br /> 29 applicant possesses the following qualifications: <br /> 30 1 . Must be at least eighteen years of age; <br /> 31 2. Must possess a valid state of Washington motor <br /> vehicle operator's license; <br /> 32 <br /> 3 <br />
