Notwithstanding subsection C herein, a license suspension/revocation shall become effective immediately 4 without the benefit of any pre-suspension/revocation hearing when the ordinance requires a summary revocation/suspension or when the City Clerk determines that it is in the best interest of the health and/or safety 6 of the citizens of Everett to do so. 7 E. Within ten (10) days following the date of revocation or suspension of any license issued pursuant to this 8 ordinance, or within ten (10) days following the date of denial of any license regulated by this ordinance, an 9 appeal may be filed with the City 's Parking Hearing Examiner. Upon the timely filing of an appeal , the 10 licensee shall be afforded a hearing before the City's Parking Hearing Examiner after notice as provided herein 11 has been given. Said appeal shall be in writing and addressed to the City's Parking Hearing Examiner, 12 "ATTENTION: City Clerk." Notice of the time and date of such appeal hearing shall be given by delivering a copy of 13 the notice to the holder of the license or by mailing a copy thereof to the holder at his last address as shown by 14 the City Clerk 's license records which notice shall be mailed or delivered at least five (5) days before the date 15 fixed for the hearing. The City's Parking Hearing Examiner shall , within thirty (30) days after the conclusion of such 16 hearing, issue a decision as to the revocation, suspension or denial . Such decision of the City's Parking Hearing 17 Examiner shall be final and conclusive as of the date set forth in the decision, unless within fifteen (15) days from 18 the effective date of the City 's Parking Hearing Examiner's order an aggrieved person or persons obtain a writ of 19 certiorari from the Superior Court of Washington for Snohomish County for purpose of review of the action taken. 20 It is unlawful for any person whose license has been 21 revoked or suspended, to keep the license issued to him/her in his/her possession or under his control , and the same 22 shall immediately be surrendered to the City Clerk. When revoked, the license shall be cancelled, and when suspended 23 the City Clerk shall retain the same during the period of suspension. 24 25 Section 2: That Section 13 of Ordinance No. 1400-87 (EMC 5.68.150) 26 which reads as follows: 27 Section 13: DRIVER'S LICENSE - QUALIFICATIONS 28 A.
