ORDINANCE NO. 2975-07 y An Ordinance Amending City Regulations Pertaining to the Board of Adjustment, - Ordinance No's. 2050-95, 2151-96, 2240-97, 2530-01,2719-03,325-74, and 534-78. WHEREAS, the City of Everett did create a Charter Review Committee in 2006 to review and recommend certain changes to the City of Everett Charter for consideration by the Everett City Council; and WHEREAS, the Charter Review Committee did recommend various changes to the City Council, and the City Council placed potential amendments to the City of Everett Charter on the September 19, 2006 ballot, including the elimination of the Board of Adjustment; and WHEREAS, the voters of the City of Everett did approve the amendments to the City of Everett Charter, including the elimination of the Board of Adjustment; and WHEREAS, such action by the voters requires certain amendments to the City's Local Project Review Procedures (EMC Title 15) and other sections of the Everett Municipal Code; and WHEREAS, the City Council finds that the amendments to the City's Local Project Review Procedures (EMC Title 15) and other affected sections of the Everett Municipal Code promote the best long term interests of the Everett community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. Section 4(B) of Chapter 4 of Ordinance No. 2530-01, as amended by Section 2 of Ordinance No. 2719-03 (EMC 15.16.110.A.17), which reads as follows: 17. Variances in conjunction with any decisions for Review Process II or III permit applications; Is hereby amended to read as follows: 17. Variances in accordance with EMC 19.30.080, EMC 19.41.130, EMC 19.34.070(A)(2), or EMC 20.08.180; 1
