0 Section 2. Chapter 4 of Ordinance No. 2530-01 (EMC Chapter 15.16) is hereby <br /> amended by the addition of a new section, to be codified as EMC 15.16.205, which reads <br /> as follows: <br /> Variances to the requirements of the Zoning Code (EMC Title 19). <br /> A. Criteria. The criteria to be used for evaluating variance requests are specified in <br /> EMC 19.41.130(C). <br /> B. Denial of a Variance. Denial of a variance or a minor change of an approved site <br /> plan shall become effective as of the date set forth in the order. No person shall <br /> be allowed to apply for the same variance or minor change on the same site <br /> within one year following the effective date of the order denying the variance or <br /> minor change. <br /> Section 3. Section 1(A) of Chapter 4 or Ordinance No. 2530-01 (EMC 15.16.010), <br /> which reads as follows: <br /> Land use permit processes. For the purpose of project review, all land use permit <br /> applications shall be classified as one of the following: <br /> A. Review Process I, minor administrative review decisions; <br /> B. Review Process II, planning director administrative review decisions; <br /> C. Review Process IIIA, hearing examiner decisions; <br /> D. Review Process IIIB, hearing examiner and city council quasi-judicial decisions; <br /> E. Review Process IV, board of adjustment zoning variance decisions; <br /> F. Review Process VA, planning commission and city council land use quasi-judicial <br /> decisions; <br /> G. Review Process VB, historic commission and city council land use quasi-judicial <br /> decisions; and <br /> H. Review Process VI, city council approval of final subdivisions (plats) and final <br /> approval of performance agreement rezones. <br /> Is hereby amended to read as follows: <br /> Land use permit processes.
