portable sign used shall comply with Section 36.140 of this chapter. Such special sales or <br /> event signs shall: <br /> be limited to not more than one sign per 100 feet of street frontage per <br /> business; <br /> a) be limited to 32 square feet in area; <br /> not be displayed for a period to exceed a total of thirty days within any <br /> consecutive 365 day period; and <br /> be removed immediately upon conclusion of sale/event. <br /> Section 5. Severability. If any section, subsection, clause, sentence, or phrase of this <br /> ordinance should be held invalid or unconstitutional, such decision shall not affect the <br /> validity of the remaining portions of this ordinance. <br /> Section 6. No intent to create protected/benefited class. This Ordinance is intended to <br /> promote the health, safety and welfare of the general public. Nothing contained in this <br /> Ordinance is intended to be nor shall be construed to create or otherwise establish any <br /> particular class or group of persons who will or should be especially protected or <br /> benefited by the provisions in this Ordinance. This Ordinance is not intended to be, nor <br /> shall be, construed to create any basis for liability on the part of the City, its officers, <br /> employees or agents ("City") for any injury or damage that an individual, class or group <br /> may claim arises from any action or inaction on the part of the City. Nothing contained <br /> in this Ordinance is intended to, nor shall be construed to, impose upon the City any duty <br /> that can become the basis of a legal action for injury or damage. <br /> Section 7. No effect on pending case or matter. The enactment of this Ordinance shall <br /> not affect any case, proceeding, appeal or other matter currently pending before the City <br /> or in any court. <br /> Section 8. Authority to make necessary corrections. The City Clerk and the codifiers of <br /> this Ordinance are authorized to make necessary corrections to this Ordinance including, <br /> but not limited to, the correction of scrivener's clerical errors, references, ordinance <br /> numbering, section/subsection numbers and any references thereto. <br /> Section 9. Enforcement. Violations of this Ordinance are punishable under EMC, <br /> Chapters 1.16, 1.20, 5.120, 5.124, and 5.128 and as otherwise provided by law and in <br /> EMC 1.20.020, and are subject to injunctive and other forms of civil relief which the City <br /> may seek. <br /> Section 10. Conflict. In the event that there is a conflict between the provisions of this <br /> Ordinance and any other City ordinance, the provisions of this Ordinance shall control. <br />
