• <br /> 1 ORDINANCE NO. /o71/5 --e9 <br /> 2 AN ORDINANCE authorizing the Director of Parks and Recreation to <br /> 3 enforce provisions of the City Park Code (EMC Chapter 9.06) <br /> and the City Parking Ordinance (EMC Chapter 46.28) and <br /> 4 authorizing the issuance of citations, adding new sections <br /> to EMC Chapter 9.06 and amending Section 24 of Ordinance <br /> 5 No. 994-83 (EMC 46.28.240) . <br /> 6 WHEREAS, the Everett City Council finds that the Director of Parks and <br /> Recreation should be authorized to enforce the Park Code and the Parking <br /> 8 Ordinance with power to issue citations; <br /> 9 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 Section 1 : Director Responsibility and Authority. <br /> 11 A. It shall be the responsibility of the Director of Everett' s <br /> 12 Department of Parks and Recreation to enforce all provisions of the City <br /> 13 Park Code (EMC Chapter 9.06, Ordinance No. 's 3471 , 293-74, 889-82, and <br /> 14 1035-84, as amended) including park rules and regulations adopted by the <br /> 15 Park Board. <br /> 16 B. The Director and his/her designees shall be empowered to exercise <br /> 17 the authority of peace officers to the extent necessary to enforce the City <br /> 18 <br /> Park Code, which power shall include issuance of citations. <br /> 19 C. The Director and his/her designees shall be empowered to exercise <br /> 20 the authority of peace officers to the extent necessary to enforce the City <br /> 21 <br /> parking laws (EMC Chapter 46.28) within one thousand (1 ,000) feet of any <br /> 22 <br /> City park, which power shall include issuance of citations. <br /> 23 D. Persons designated by the Director to enforce the Park Code shall <br /> 24 bear identification reflecting the authority under which they act, which <br /> 25 <br /> identification shall be shown to any person requesting the same. Persons <br /> 26 designated to enforce the Park Code shall be known as Park Rangers. <br /> 27 <br /> Section 2: Obstructing a Park Ranger Prohibited. <br /> 28 <br /> A person commits the offense of Obstructing a Park Ranger if: <br /> 29 <br /> 1 . He or she intentionally uses or threatens to use force to <br /> 30 obstruct a person he or she knows or should reasonably know is a <br /> Park Ranger and while such Park Ranger is performing his or her <br /> 31 official duties; or <br /> 32 <br />
